Hello! A friend of mine who is a Canadian citizen marry his US citizen wife. The US citizen wife applied her husband a spousal visa. While the processing is on going the husband who is a Canadian citizen stayed in the US and did not got out of the country until he received his spousal visa. In my case I'm not a citizen of Canada I'm only a Permanent resident and marrying my fiancé who is a Us citizen. I was wondering if I could also stay in the US like what my friend did while the processing of my spousal visa (one's it's being process) is on going? Please share your knowledge about this situation! Thanks!

If you are granted a tourist visa to the USA then you can only stay the allotted amount of time given to you at the POE. You can not stay the whole 12-14 months for the CR-1 processing.

If you need a visa and have a visa you can visit, duration will be dependent on what the PoE allow, usually 6 months but can be shorter.

Depends on the time you'll get on the POE - they might allow you to stay 6 months, but they can also allow you to stay 2 weeks. It all depends on them.

If your friend’s husband stayed in the US then they didn’t apply for a spousal visa, what they did is adjustment of status. He can no longer get a visa IF he stayed the entire time inside the US. 

 

You on the other hand, if you already have an existing B2 visa, then you can visit. Having the intent to stay is visa fraud. But I guess you already know that. I’m not sure if Canadian PR’s can cross the border without any sort of visa so check on that as well.
