Hi Guys! So I have an update on EAD, AOS & A Few Questions...

 

For AOS: We got an RFE in April & it was for a translation of husbands birth certificate but we sent that in a few weeks later so we’re still waiting waiting waiting :/

 

For EAD: We got a letter on Saturday that his EAD was approved and the EAD card will be here by Today according to the tracking # Oh YAY!! :) Finally! (We sent in the paperwork since June 2017 so there was a delaying with processing) 

 

And quick story for you guys to answer my question: so my husband was talking to his Mom or Dad, (i don’t remember at the moment who told him) a few days ago & somehow he/she mentioned something about my oldest brother in law. That he used to claim my husband on his taxes up until my husband was 16. And as far as we know, when you claim people as dependents that live in another country, they are given an ITIN. When we did his EAD & AOS, it asks to fill the SSN and if I am correct an ITIN is similar as a SSN? Well my question is, will my husband be able to apply for a SSN once he has his EAD Card ? Since he had an ITIN in the past/as a minor. Also will USCIS say we lied of him not having a social security number on his application since he had an ITIN before? And do we need the ITIN card with us just in case we need it to show he had some sort of card from the US while he was still in Mexico? It’s in a different state with his Dad & Brother. To sum up my questions, will his ITIN affect him in any way in his AOS, EAD or for a SSN? I am so nervous right now, I have so many things running through my mind hahaha :/

ITIN are only issued by the IRS and have no relevance with your immigration status. As far as having an ITIN issued before the proper AOS was done to your husband....IMO it will not affect his EAD. I had an ITIN to file for taxes before i did my AOS and nothing was even mentioned in the papework or interview to become a GC-holder

8/22/2018                  We are still reviewing your case and there are no updates at this time (same email again)

9/5/2018                     We are still reviewing your case and there are no updates at this time (this is getting boring!!!)

10/3/2018                  We are still reviewing your case and there are no updates at this time (this is insanity, 4th time while some got GC)

10/17/2018                After 136 days of wait in HELL, finally EAD in production

10/21/2018                Card was mailed to me, and yes it said so on a Sunday night, while Vj-ing

10/22/2018                Card was picked up by the USPS

10/24/2018                EAD in hand. F%^&& finally

12/28/2018                Interview has been scheduled. Waiting for notification with date by snail mail

Thank You Guys So Much! I ended up sending the documents the day I posted the question. My husband got his EAD in the mail last week and just got his SSN in the mail 3 days ago. We are so excited but nervous because a few minutes ago Case status for AOS says “my interviews was scheduled” OMG we are so nervous but happy because after a year of waiting he got his EAD & now his interview :o
