You saying that you sent a photocopy of the i130 instead of sending the handwritten i130? If so, was it signed and completed as necessary? If yes, then i don’t think you should have a problem but I’ve never read about this happening before. I’d either call and find out what happens or get an infopass and explain situation. I know it seems like a stressful situation you may also want to see if they just accept it. When did you mail it out ?

The petition itself is about the only document that requires a "wet" signature

How do you call?  and what is an infopass?   Thanks!

Info on contacting USCIS here. I think you might need to wait until you get a receipt number of your I-130 petition. That should come in 2-3 weeks via mail. You'll get the email earlier if you filled out the e-notification request form on top of your petition.

So I sent in my I-130 application in yesterday.  Today we realized that the in the application we sent photocopied documents - signatures included.  Big mistake because USCIS requires an inked signature.  So I was had a though of putting a stop-payment on the check I sent with the application since it will most likely be rejected.  Is this a wise course of action or will it result in longer delays and possibly put my wife's immigration into jeopardy?

If they are going to reject the filing, then they won't deposit the check anyway. I'd suggest waiting and seeing if they accept it as-is. Most documents don't require an inked signature. Per their signature guidelines (https://www.uscis.gov/news/news-releases/uscis-finalizes-guidance-signature-requirements), a photocopy of an inked signature is as valid as the original so it may not even be an issue.

So they will either:

1) Accept it as-is

2) Reject it (and the check is not deposited)

3) Accept it and issue an RFE later. This is unlikely to delay your case any more than a rejected filing -> fixing it -> resending the petition.

No that would be rejection I believe. Original inked signature is required to accept the application. Just submit everything again. If geowrian is right about signatures, then you are fine.

Yeah the consensus is that it will be rejected.  Ok thanks for calming my nerves!

I concur that rejection is the most likely result. But there's some hope that it will be accepted. Either way, no need to do a stop payment...just wait it out. :)
