I-130 and I-485 - Applying Concurently

Hi All,

 

I became US citizen in march and my parents arrived in the US the same month. I am intending on applying for I-130 and I-485 concurrently. I wanted to know from you all if I can petition for them considering they have been here only for two months. I was not expecting to be naturalized. And petitioning for them was not in the plan until I received my interview and oath ceremony letter. So there was never the intention to immigrate after arriving here. The circumstances changed and since they are here, its convenient that I petition for them whilst they are on a visit. They are both in their 70s.

 

My question is do they have to be here for a certain period of time before I can petition for them for example 30, 60, 90..days?

Hmmmm someone correct me if I’m wrong but I don’t think they can adjust status. What visa did they arrive with? If you’re petitioning for family members they have to go back to their country and wait out the process. It’s currently taking 7 years.

Parents of a USC can adjust status from inside the USA

Not an Immigration issue.

 

I assume either you ar they, maybe both are independently wealthy, not many could contemplate such a commitment.
