The person who did the smuggling....are they currently in the US or back in their home country?

Also, does the person have a qualifying relative to apply for the waiver?

Applied for Naturalization based on 5-year Residency - 96 Days To Complete Citizenship!

July 14, 2017 (Day 00) -  Submitted N400 Application, filed online

July 21, 2017 (Day 07) -  NOA Receipt received in the mail

July 22, 2017 (Day 08) - Biometrics appointment scheduled online, letter mailed out

July 25, 2017 (Day 11) - Biometrics PDF posted online

July 28, 2017 (Day 14) - Biometrics letter received in the mail, appointment for 08/08/17

Aug 08, 2017 (Day 24) - Biometrics (fingerprinting) completed

Aug 14, 2017 (Day 30) - Online EGOV status shows "Interview Scheduled, will mail appointment letter"

Aug 16, 2017 (Day 32) - Online MYUSCIS status shows "Interview Scheduled, read the letter we mailed you..."

Aug 17, 2017 (Day 33) - Interview Appointment Letter PDF posted online---GOT AN INTERVIEW DATE!!!

Aug 21, 2017 (Day 37) - Interview Appointment Letter received in the mail, appointment for 09/27/17

Agreed....this is not DIY territory. You should seek out a very good immigration attorney who has done a waiver for this type of circumstances before.

1/2/18: EAD + AP approved (no website update), 1/5/18: EAD + AP mailed, 1/8/18: EAD + AP approval notice hardcopies received, 1/10/18: EAD + AP received

9/5/18: Interview scheduled notice, 10/17/18: Interview

10/24/18: Green card produced notice, 10/25/18: Formal approval, 10/31/18: Green card received

Get yourself a REALLY good attorney. one who has done this thing before and knows his/her stuff! 

And be honest. wirh everything. give all the details

but I seriously doubt that you‘d get a waiver for this matter...sounds.....let‘s say...not easy!

Actually a lawyer is running the case, but I want to check examples and ideas, to be pretty sure that he is doing it right. But I had not been  able to find that.  And yes, I know cases where the smuggling waiver was approved.

I have come across these but now I think of it they have not been a sole issue and have been part of an I 601 for other reasons. would be the same sort of deal, go to the interview get refused for a waiverable smuggling and be told what to file, I sort of assume a I 601 but have never come across this as a solo issue so may be wrong.

Yes, the person is in Mexico. Yes. CDJ inforormed  alien about the need of a I 601 waiver for smuggling during the consular interview.,

Sounds normal, was this the only issue?

My impression has been that this is considered a minor tack on issue so I doubt a well prepared waiver would not be approved.
