It depends. Many places the standard highway speed limit is 65 mph.

 

If it wasn't properly posted for 55 mph where you were, then you may not have done anything wrong.

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

It was interesting that when Arizona stated they wanted to help the Federal Government, the previous administration fought it in court and won.  I believe this is the strategy being used now against some sanctuary cities.

I believe it depends on the state.

 

There are standard speeds, which you must foow even if it isn't posted. If they want you to drive a speed other than the standard, it has to be posted.

 

So if the standard freeway speed is 65 mph in your state, it has to be properly posted if they want it to be 55.

 

I've gotten out of speeding tickets in California with that reasoning. Not highway speeding but entering a town the speed limit dropped by the sign was hidden behind a tree. I argued it was impossible to know that the speed limit had changed and therefore I wasn't responsible.

 

I'll look for a source.

Naw man I should find a source. I was speaking from anecdotal experience and I should have made that clear. I preach for sources all the time, so I should keep to my own standard.

 

All I found were drivers manuals establishing "speed limit standards" (e.g. 65 mph on a highway, 30 mph on an urban road) and that in the absence of speed limit signs then you must assume those standards.

 

Nothing I found was clear about the scenario I mentioned (which I myself was in). In California I was entering a small town in Marin or Sonoma County (I forget). The road I was on was previously a 40 mph road and I was stopped because I was going over the "30 mph limit" for the town (assumed speed limit). I argued to the officer that there was nothing posted that I had entered the town yet and so it wasn't clear when the new speed limit applied. He agreed and let me off. I think it would have been an even easier case if I was going say 28 mph and he said "The speed limit is 20 mph". If a road deviates from standard speed limits, it needs to be posted (because otherwise how would you know it has deviated?). If the standard speed for a highway in a state is 65 mph but they want to enforce 55 mph, they need to post that speed otherwise you can't be faulted for assuming the standard speed.

When I was looking for a source I found another article discussing the difference between "presumed" and "assumed" speeding states, which I was not aware of.

 

In some states you can take your speeding ticket to court and argue that despite going over the speed limit you were still driving in a safe way (Like for example if you go 75 on the freeway in a 70 zone, but it's a clear day, Sunday morning, with no traffic). In those cases you are "presumed" to be speeding if you go over the speed limit, but ultimately speeding is defined as being unsafe so you could argue otherwise. It works both ways as well. A cop could technically ticket you for going under the speed limit if he believed conditions warranted an even slower speed. For example if the speed limit is 65 but there is dense fog, or ice etc... Seems a little more difficult to enact that side of it in practice though.

Deviant roads should be required to register and to undergo intense counseling.  This kind of behavior is unacceptable in today's "zero tolerance" society.

No man. My reputation as a logical middle of the road occupier needs to be upheld. If I ask sources of other people, I should try to provide sources myself. I'd like to think I'm usually pretty good at it.

The roads can just be closed for 24 hours for reeducation and then we should be good.
