Hi,

 

We sent my husband’s AOS packet April, 6th. About two weeks ago we recieved a rejection letter for his work permit application because he didn’t sign it (signed in the wrong spot), and an incorrect fee. We called USCIS about the fee since there’s not supposed to be one if you file with the i485 (they cashed the check for those required fees). They told us to sign the document and resend it with a copy of the i485 NOA1, when we told them we haven’t recieved it yet they told us to call back at a less popular time to have our case elevated to an Immigration Agent. So we recalled and they directed us to an Immigation Agent, but  because of the high call volume an automated machine took our number and said someone would call us and no one ever did. My husband is getting really depressed, he can’t work and the strain has been really difficult. I don’t understand what’s happening. Why have we gotten the rejection notice for the work permit but nothing on the i485? I feel like we’re in limbo.

Check the USCIS website with your receipt number and see what it says. You should have gotten three separate receipt numbers one for each form you submitted (AOS, EAD, AP). AOS is taking about a year to go through and you won’t hear anything until they make a decision. The current correct fee for AOS is $1225. Is that how much you sent? If you sent the corrected paperwork back to them they will update your case. You should be able to follow updates online or via text message and email if you submitted the form for it with your initial paperwork. You can call USCIS and make inquiries but I feel you will get nowhere with it. They might just be processing the new stuff you sent.

Also, you’ve only sent this a month ago and you knew that it would take a long time until he can work when you filed for K1. I’m not trying to be rude, but that’s what people have to realize when coming on a K1 visa. They know beforehand they’re gonna be in limbo for a long time and have to plan accordingly. See if there are community things he can get involved with that will get him out of the house.

We sent the right fees I checked like 100 times. We only recieved a receipt number for the EAD paperwork unless they are all tied into one, we haven’t  sent the corrected forms back we can’t until we receive the NOA1 for the i485 to prove we have one in process so we don’t have to pay $410. I think that’s what he’s so depressed about, because the most important document isn’t being processed right now.

Hmmm... I would try checking receipt numbers immediately proceeding or following your EAD receipt number on the USCIS website to see what comes up. Your AOS, EAD and AP are all entered in the system at the same time if you submitted them all together and they will have concurrent receipt numbers. You will have a receipt number for each one. So if your receipt number for your EAD ended in let’s say in 76, I would try looking up receipt numbers ending in 77 or 75 etc. if that makes any sense.  Change the last two numbers.

Update: it’s been two months and still no NOA1

 

They probably lost the packet, but funny enough they didn’t lose the check for $1,250. He’s probably going back to Brazil since we can’t afford to pay another $1,250 for them to lose it again.

the fee is $1225 not $1250

10/17/2018                After 136 days of wait in HELL, finally EAD in production

10/21/2018                Card was mailed to me, and yes it said so on a Sunday night, while Vj-ing

10/22/2018                Card was picked up by the USPS

10/24/2018                EAD in hand. F%^&& finally

12/28/2018                Interview has been scheduled. Waiting for notification with date by snail mail

him moving back to brazil makes even less sense. it will cost more money to file a cr1

 

keep trying to get a person. see if maybe your congressman can help, or even an attorney.

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

That's terrible! I think they only have 30 days to send you NOA1 for AOS so that's way past it. Did you manage to get through to somebody???

We talked to one immigration officer and he said he had no record of my husband in the system and kept rudely asking for an alien registration number which he doesn’t have. He than told us to email LockBox Support, that was like two weeks ago and they haven’t responded yet, I’m sure they’ll just pass the buck to someone else. It’s just so frustrating to see people who sent their package after us already complete their biometrics and we don’t even know the location of our papers. By the average time line he should’ve been getting his EAD card next month but now we’ll be lucky if he gets anything this year.

It wouldn’t cost anything but the plane ticket because we wouldn’t be coming back but it’s just the frustration talking. 

 

I’ve filed a case with the USCIS Ombudsmen they’ve already reached out to USCIS and are waiting to hear back from them.

I cannot believe how frustrating it must be! Our whole package got rejected and returned but they never cashed our cheque so it was easier to resubmit. Did you try an infopass appointment?

Unfortunately, a lot people wait 5 or 6 or even 7 months for EAD nowadays...

I tried but there’s none available in my area.
