What is her household size? If she is only supporting herself and you, it's just over enough for both the K1 and AOS process. With that said, Casablanca is known to scrutinize cases where the petitioner barely is earning enough to support themselves and the beneficiary. A common question that we have seen recently from the consulate is "how did the petitioner afford multiple (if she has made more than 1) visits to Morocco on such a limited income? You may want to prepare an answer to a question like that come interview time.

She have custody of grankid  she get like 700$ monthly for him and shes retired from other work 4 years ago that she been working 13 year she get from t 900$ monthly and in 2016 she get disability from second work that she been working 15 year cause she been hurted in her back and she have all prove from her doctor and she been paying the inssurance thats why she get monthly 2000$  and she have her house too buy her name 13 years what you thing her support to me everythings is good ?

Is the $700 a month counted towards the  $2000 a month? Is the $900? 

 

Child support does NOT count as income,  so that  $700 a month does not matter in her income. However the grandson DOES count on her household size, so her 100% income for a family of 3 (You her and the grandson) is $20,780 a year. However to adjust status, she needs 125% of poverty line which is $25,975 a year, which, unless you have not counted the $900 a month, she would not meet. 

 

As @RJandHamid said, Casablanca often wants to know how trips were paid for if income is on the border. In addition, they often want the fiance to have met any children living in the home.  In addition, they can deny one they may feel would become a "public charge" as indicated by USCIS criteria, https://www.uscis.gov/greencard/public-charge.  

 

If she owns her house and has no mortgage with the bank, she would need a current appraisal which would be 3 times the amount needed for AOS,  so roughly $78,000. They often do not like to do this in Casablanca however, because if she had to sell the house you would be homeless and more likely to become a public charge.

If her grandchild is living with her, s/he must be counted in household size. If her income is $2900 a month, not $2000 as you said, then yes you would be ok in theory, but the consulate may still have a problem - It's up to their discretion

Iappreciate that ihope income 2000$ of disability is count imean is acceptable for support with 900$ of retirement too ?

Ok, all your specifications are confusing. How much money does she make a year, not monthly and not detailed, without counting child support? Just add the numbers up and give us a yearly income. If your household is of 3 people you’re gonna need to match that to the list under 3 people. However much that may be and you can get that list from USCIS or even VJ.

sounds like the job is paying a disability now ( that normally  lasts 6 months as it is short term disability) and then she must apply for SS disabilty which takes a long time to be approved /normal for SS to deny and person needs lawyer to fight to receive SS disabiltiy benevits

I say this as SS disability (my son has had 26 surgeries and just got his benefits) and he receives $1830 not 2000 each month

now the bigger issues will be the Casa embassy

Did you meet in person ?

This is a K1 and Casa  does not like to approve them

Can she come to Morocco to get Married ( do not marry on the  first trip)

Does she file tax returns on this income as she will have to show 3 years tax returns 

If you get an interview the embassy will want to know how she is able to travel / not only how she can afford but how she deals with the flight and a  bad back and the tiolets in Morocco (and yes they will ask) Hard to use some of them when your back is bad

Embassy will want to know how well you know her,  how long,  how many trips has she made

they will question u as to your plans in the US (study or work)

they will question the age difference as she has a grandchild and they assume all moroccan men want their own children

this is not a fast or easy process especially in Morocco 

we wish you good luck just remember to be honest always with immigration

be serious with the relationship as they are known to even deny CR1 marriage applicaitons so it will not be easy
