Most likely, he can. Just the same as a USC has a right to enter the US (even without a passport, even though you are supposed to have one), I am assuming it's the same for other countries.

Now how to get on a plane without a valid ID is another story.

I didn't see mention of the type of visa that was expired (maybe I missed it?).  But not all expired visas are the same.  If he came on a fiance visa for example, he would only be able to AOS if married to the original petitioner.  What visa type did your fiance enter on?

Instructions posted earlier, stated he needs to have his visa and photo copy of it, with the passport application, it did not mention it needs to be unexpired visa. They need a proof he entered legally in the first place.

 

In any case, consulate or embassy is the only place that can help him with accurate information about renewing his passport. Embassy can, and will, provide him a valid passport for at least long enough that he can travel back home, because, he can't travel without valid passport. 

 

Note to original poster, would be much more helpful and useful to provide accurate information and circumstances, instead of provide partial and not necessarily true info. Community can't really help if not knowing the facts, like expired passport is different the passport that is about to expire. You probably would of gotten more accurate information quicker with a little more detailed and factual posting.

 Best way is to go to local place where you are planning to get married and ask them what are the requirements and explain your case. When I got married the lady in city hall told us that my wifes birth certificate looks like "typed" but she used the same doc for all of her immigration process and she refused to issue marriege license to us. Then we went to another county where they only needed to show drivers license and we were fine. So every county has different rules. Check with them by going in person to avoid last minute surprises.

If the passport is "about" or already expired, you can renew it in your country's consulate or embassy.  When you have a valid passport, you can get married in Texas or any other state. Or maybe you guys can go to Las Vegas as well. After marriage, you may start AOS process.

If you are going back to your home country you can.  You can even get on a plane without any valid ID.  You just need to go through extra screening
