There is no form.  Write a letter to the field office handling her case, stating you are withdrawing the affidavit of support.  Include in the letter her full name, case number, and your full name.  You can also drop off the letter at an infopass appointment with USCIS.  You do not need to give a reason for the withdrawal (although up to you if you wish to provide one), but I would suggest mentioning in the letter that the GC has not been issued yet.

Timeline

filed dec 6 2017. I had congressman looking into why it was talking so long to get ead. I then contacted about the arrest they had me add a fraudalant marriage claim to file since incident happen 3 days after our 6 month wedding anniversary. Said it pretty phony.

 All you need is a letter stating you want to withdraw the I-864. You will have to provide all of the info about your wife (Name, BD, case #, etc)

Now is the time to protect yourself. I know there may be some emotions involved which is why you stated earlier about a misunderstanding, but you have to think logically. This is a serious action your wife has taken. Unless there is more to the story* a spouse does not call police and get protective custody to where you can't even return to your own home over an argument.

 

Think about this for a minute. You lost your freedom, home, and possible marriage over this.

 

*Disclaimer: If there is more to this story and there was a legitimate reason for your wife to call the police, then obviously you will have to face the consequences of your actions.

no theres not more to story. we had argument over money was trying to explain if I sent money $270 to dad in Colombia, $235 for her sons field trip and $191 for her dental there was not any money left for fun things. After agreement went grocery shopping at walmart and kwik trip and drove in silence 45 minutes home. We unloaded groceries and  I packed suitcase and gathered a few belongings and left. Didn't say a word. was hopeing to talk to her in a day or two. that was three weeks ago. After I left my wife called police. Then they arrested me

I agree with others about pulling the 864. I'm curious as to why a lawyer would tell you not to.

 

As for the "misunderstanding" - I read that as he was referring to misunderstanding about what steps to take (i.e., whether to withdraw the I864 or not), not a misunderstanding between him and his wife. He seems to be pretty clear about what happened that day. Not to take a side here, because it's best to remain neutral on here since we are only getting one side of the story after all, but - no, wives (or husbands) don't usually file domestic charges due to confusion or a misunderstanding... but they can certainly do it with some kind of ill intentions. It's not our job to judge or decide who was right or wrong in their personal issues - all we can do is answer the questions the OP has, to the best of our ability.

IN my opinion all this sounds a bit  strange! We don‘t know the whole story but if it is true that nothing really happened then 

 

I guess I would also advise pulling the I864 and then go to your court appointments and basically see what happens and have a trustworthy lawyer with you...and go thru withthe divorce as well.

I don‘t really know what else to suggest!

 

But if there‘s more to this story, and there is a legitamate reason for your wife having arrest you, you have to face the consequences

Based on your responses to everyone telling you what needs to be done before screwing your whole life. I get the feeling we will see you back here complaining about having to pay the scammer (wife) until one of the following is true for her:

 

A.
Becomes a U.S. citizen;
B.
Has worked, or can receive credit for, 40 quarters of
coverage under the Social Security Act;
C.
No longer has lawful permanent resident status and
has departed the United States;
D.
Is subject to removal, but applies for and obtains, in
removal proceedings, a new grant of adjustment of
status, based on a new affidavit of support, if one is
required; or
E.
Dies.

 

Divorce does not terminate your obligations under
Form I-864.
 

 

Please listen to the people telling you to withdraw your I-864.  Your lawyer is steering you wrong!

Of course she has. I was just reading domestic abuse laws in SC and coincidently or not, the first 3 points are the ones you are supposedly charged with lol  Be smart, pull the I-864. Write the letter and courier it to the field office.
