HELP...ANY LPR WITH CRIMINAL RECORD

Hello,

 

Please is there any LPR with criminal record travel lately? I will like to know their experience at the airport with CBP on the way back.. I was convicted for Identity Theft in 2012 sentenced to 224 days credit for time served with 3yrs probation which i completed in march 2015, my 10yrs green card was renewed after many info-pass the IO told me my file is with the supervisor due to my criminal record that the supervisor need to contact some people regarding my conviction and finally approved in nov 2017 after many info-pass. I will like to plan a trip to my country in December but im very concern about my returning to the US at the port of country with CBP. If there's anyone on this group who travel lately with LPR with conviction to share their experience please.

I can only speak on my own experiences traveling as an LPR with a criminal history...(I am a naturalized citizen now)

It really didn't become an issue BECAUSE of my legal status as an LPR, since I had already proven to USCIS as being admissible.  If I were entering the US just on a tourist visa, I assume it would have led to more scrutiny/denial of entry.

July 14, 2017 (Day 00) -  Submitted N400 Application, filed online

July 21, 2017 (Day 07) -  NOA Receipt received in the mail

July 22, 2017 (Day 08) - Biometrics appointment scheduled online, letter mailed out

July 25, 2017 (Day 11) - Biometrics PDF posted online

July 28, 2017 (Day 14) - Biometrics letter received in the mail, appointment for 08/08/17

Aug 08, 2017 (Day 24) - Biometrics (fingerprinting) completed

You should not travel without speaking to an experienced immigration attorney about your conviction. 

 

It's possible it made you inadmissible, but not deportable. In which case you may be denied entry.

If you were able to renew your green card than it’s a big good news for you. 

Now since it’s been 5 years of your conviction, why don’t you file for citizenship ?

you got your green card because you were not inadmissiable nor deportable .

I don’t believe you will have issue entering US ,  maybe have to go secondary inspection.

file N400 now, if you successfully renew your GC that’s mean you will be naturalized aswell.

I plan on applying for citizenship but I think you can only apply for citizenship 5 years after your probation, I’m not sure if it’s 5 years after the conviction of 5 years window after probation.

It’s not after probation, it’s after the conviction date.

you were convicted in 2012, file N400 as soon as tonight.

its been more than 5 years since your comviction and you served probation and successfully dismissed the case.

All you need is certifited copy of your final court disposition ( get atleast 2 copies ) .

if you were deportable, you would not able to renew your green card without wavier.

so you are in good shape.make sure mention this arrest on your application and bring origional certified copies of dispositions  with you to the Interview. 

 

Every lawyer will tell you same what I told you. 

And at this point don’t travel.

Apply online, you can do it yourself.

its very simple procedure, and don’t bother to contact attorney cause you be losing money. 

Who knows you be citizen in 6 months or less.

final court disposition is very very important ( must be certified and stamped ) amd get a certified copy of police report aswell to be on same side . 

I did it, you can do it too.

After many research I contacted one of the best immigration attorney in Florida and this is what he said.

 

You will be eligible to fulfill the "good moral character" requirement of naturalization exactly after 5 years when you ceased being in probation.

 
I guess I’ll have to wait until March 2020 to be able to apply for citizenship.

Good luck with you, but the GMC start from the date of conviction, not from end of probation.

I was told by my immigration attorney. Maybe your case is different from mine.

Domestic violence,  Assault and battery. My wife called police on me, and i was convicted and signed a plea deal.

My lawyer told me, as long as, you are out of probation, and its more than 5 years of your conviction. You are eligible to file N400.

I did, and successful naturalized, without any issues.

I am from Kentucky and was naturalized last month. USCIS approved my application right after i finish my probation.

Get a certified copy of your " Final Court disposition & Certified copy of the police report ".

Better have them with you at the time of interview.
