Hello you guys some feedbacks would be greatly appreciated!!. I travel with an expired advance parole while on DACA had no idea. The person that did it for me told me I had it for one year. I had no idea there was an actual date nor pay attention to date I thought  automatically had it for one year since .now am at my country, what are my chances of getting back home. Am already depress with all this going on. I need some advice. We filed the i130 already, would I have any consequences or of been denied...helppp

I feel bad for you and it's terrible that people's lives are bring played with for politics.  No one can say what will happen as it's in the air.  It will take several months. But hoping some good news starts to come out about it.

Just to be clear: You left the US with an expired AP card and are now wanting to get back into the US? You should've applied for an extension of your AP card before. With NOA1 it would've automatically extended your card for another 180 days. 

I am not very familiar with DACA policy but usually travelling without valid AP card means that you won't be able to get back into the US...:o

Yes I've mistakenly left with an expired advance parole while I had DACA, but that was last year that happen so. My husband files the i130 for me now we just waiting. But am still concern how the fact that I use to leave in the usa as a child might affect my consular process

When and on what visa did you most recently enter the US? 

 

When was your DACA/AP granted? 

 

When did it expire? And when did you leave the US?

Am 29, I came to the usa with an adult, I was 10, I had daca since 2013, advance parole was granted on 2016 June just for one month left the usa one December of 2016 since I thought the paper was good for one year,biggest mistake😭😭, so they only granted me the advance parole for one month?  My daca than soon expired on 2017 july, ever since than I've been here , than on December 2017 husband sant my i130 .so now we waiting

It sounds like you have a ten year bar since you have at least a year of illegal presence after the age of 18 but before your DACA was approved. 

 

If true, your bar would expire in 2026. A waiver is available.

So you left in December 2016 and your DACA expired in July 2017??? Your AP was for one month only, do you still have the AP on you? Why didn't you know that there is a date on there?

Yeah, your best bet is to wait for the I-130 to get approved and then file for a waiver (I-601) and hope that gets approved.

If this is the first time you have left without AP, since you came to the US, you triggered the 10-year bar. Also, DO NOT try to sneak back into US because you'll probably get the life-ban and be unable to adjust, ever.

You'll need a lot of patience. I wish you the best of luck
