I-130 petitioner outside us

Hi all,

Is there any advice for a married couple that both live overseas? (The petitioner is the wife and has decided to live with her husband so that family can stay together especially that they had a baby)?
Now they all want to move back to the US.

Can the wife show US Domicile?

How long has the US wife been living outside of the States?

Has she filed US taxes during those years? (part of showing proof of domicile)

Yes, she has been filing taxes. Actually the I130 has been approved. Now at the filling out the I-864 stage.

The sister will be providing the affidavit of support since she is living in the US (both husband and wife do work overseas but are afraid that their resources might get judged insufficiant for sustaining a living in the US, though really they should be sufficient)

Proving domicile is normally things like proof of US-based employment offers (or looking for US-based employment), proof of where the couple will be living in the US, active US bank accounts, US school enrollment for older children, things like that.

I think you'll find that many people (maybe most?) on here have gone through a similar experience as this is quite common. The advice you received above regarding employment offers, bank accounts, etc is good advice. Personally I used moving quotes, correspondence with apartment leasing agents, my active US bank accounts, my active US driver's license, and a few others and had no problem.

if your are living together the wife should show that she is  planning on restablish domicile in the US to write letter and natorize it she should be fine.
