An assigned Child support arrears

Good Morning Visa community 

 

l would like to find out why was my bf  issued a renewal of his driver license irregardless of a huge amount of un-assigned child support arrears ?

The reason why we wondering is because we expected his license to be rejected due to the huge 17k debt he owe in back child support arrears.

My question now is has the laws changed and if he is to apply for his expired passport will that be issued  or the only way to know is to apply for one ? 

 

Or is it because his arrears are not assigned so he is not listed in the list prohibiting him to renew the above mentioned documents .

The only period he defaulted in his payment was back in 2005 due to loss of his job for a duration  of 5 years but as soon as he got another job. 

He's been paying the child support portion and part of the portion for the arrears.

I assume your bf is a US citizen?  Here is info directly from US Department of State on obtaining a passport with child support arrears:

Normally you have to get the arrears down to at least $2500 or less to be eligible for obtaining a passport.  Check with the appropriate child support enforcement agency where he is living, and make appropriate payment arrangements before applying.

In the state of California, typically A one-time temporary license will be issued for 150 days. A driver's license, excluding commercial driver's licenses, may be extended an additional 150 days. If the person is in arrears for more than 30 days.

I have no idea, im not sure how this is K1 related and .. why would you want to be with someone who is not paying child support?

10/14/21 (havent heard anything... when do i start to get worried?)

1 .The lady was not sure who impregnated her for like 2 years  

2 - As soon as he got a job he did start paying till to day ,

3. I did state the reason why he could not pay 

4.We considering applying for K1 but I want us get the arrears sorted out before we can start a new life

If he has an agreement payment plan for the arrears then the state's Child support enforcement should sign a release even if he has more than $2,500. Same way with Driver license. If he is currently paying, paying arrears they won't suspend it. That would be counter productive. 

 

I am a child support payer and I know the feeling he is going through. So yes if he goes down to the child support office and request to be able to get a passport they'll probably allow him takes a few weeks and then he'll receive a passport for ten years.

Passport issuance is a federal issue and should be the same across the country

DLs are state issued so it varies from state to state

Yes, but the state's the one who notifies the federal government. The state has the ability not to notice the federal government of the arrears and will do so if the obligee is working with them and request them not to do so.

Yes, but the states cannot go outside the boundaries of the federal guidelines PRWORA.  The interpretation of what is a "satisfactory agreement" between the obligor and the State agency is subject to interpretation but once your name is on the list it is on the list and no passport will be issued until removed
