Hello everyone,

 

I have a few questions regarding the K1 process and I do apologize in advance if these question(s) has been asked already.  I've been getting myself familiar with the whole process and have a pretty good idea.  My question(s) mainly concerns the final part of the K1 process mainly after the medical and interview.

 

From my understanding, after my fiance passes the in person interview, it takes 1-2 weeks for her to get the visa.  So my questions are follow:

1) How long does my fiance has get to the US so we can get married?  

2)After signing the marriage certificate, can she go back to her Europe, where she is to take care of her personal life over there.  i.e. house and resignation from job

3)If 2 is not possible, can the visa be pushed back to a later date such as 3-6 months out so she can take care of her stuff.

Hi there, Answers as follows:

 

1. She will have 6 months from the date of the visa issuance- the expiry date will be noted on visa. She has 6 months to get to US and then 90 days to marry from entry.

2. No not straight away- once married you can apply for change of status and get advanced parole/work authorization but this can take 3-5 months. If she leaves before this she may not be allowed back in as K1 is one time entry.

3. Yes- as per 1 she can enter any time up to the visa expiry of 6 months.

1. The visa  (k1) will be good 6 months (usually from the medical exam date).

2. Your fiance will not be able to travel outside the US after the she enters the US on her k1 visa  (until you guys apply for AP...advanced parole)

3. She has 6 months to travel on the K1. She can fulfill her obligations and then travel to the US.

Once approved, the visa will be valid for 6 months after the medical date. So if you have your medical exam June 1st, your visa will only be valid until December 1st.

No- after she arrives you have to get married within 90 days. After you get married, you will file for adjustment of status and should include the employment authorization as well as advance parole. Advance parole (AP) is a travel document that has to be obtained before she would be able to leave the country.  Because the K1 Visa is a one-time entry visa, if she leaves the country before being granted AP, you would abandon  the K1 process and would have to start over with a spousal visa which takes a little over a year.

You can always try to extend the application as far out as possible. The validity of the petition is 4 months after you receive your noa2, which is your petition approval. So if your petition is approved June 1st you would have to have your interview before October 1st.  At that point you could do your medical exam and go to the interview and if she is granted a visa then you would have 6 months from the date of the medical to enter the US.

05/25/2018- HE'S HOME!!! 💙💙💙

whoa thanks for all the quick responses everyone, I really appreciate all the information.  I will let my fiance know the information you guys have given me and look more into the advance parole to explain to her!!  3-4 months is really all she needs to take care of her business as her work place needs 3 months of advance notice for resignation.  thanks again!
