Hello guys,

 

please I need your wise opinion about our situation,

 

Me an my US citizen wife are living abroad. our case filed last November and we're expecting it to be approved by next August.

My wife is having an internship program for 7 months and she will have it in the US. we will both move together. when she's done with the internship she has to go back to where we came from to finish her last year of school and I will be staying in the US. After that she will come and settle with me. we can prove that she's away because of her study abroad. and surely she will be visiting me constantly during that year. 

 

So is this risky ??? has anyone been away from his\her partner like this situation under some certain circumstances like me ?

 

BTW all other issues like domicile establishment, Taxes, .. etc are being working on. but my above  issue is worrying me because my wife hasn't lived there since she was born there.

 

need your advise please

No risk if you can effectively document and explain the reasons for the separation.  If you can't document and explain then it may be an issue.

 

You still need to take the needed steps to combine your lives as any other married couple would

Your case may be approved by August, but you may not receive your visa to go to the US by then. After your case is approved, you still have the NVC stage and then waiting for an interview. I believe the process is taking 12-14 months in total at the current time, so your timeline of expecting everything to be done in 9-10 months may be a bit optimistic. 

 

Does her internship start in August? If so, she may end up going to the US before you get your visa, then you could follow when you do. 

If she has not lived there since she was born, does she have friends/family in the US? Will she feel comfortable going before you to do her internship? 

 

I agree with the other poster - if she has frequent visits back to the US, and you can show she is only away for a short time to finish her last year of school I would think you would be OK. You will not have to remove your conditions for two years inshAllah so by then she should be back regardless.

I may have not posted the full details and i'm sorry for that. My wife's internship starts in March 2019.

 

As per uscis our case should be approved by August 2018. so by March 2019 I believe the visa would be approved ( sure after showing domicile + joint sponsor + ..etc )

 

My only point is the if she's away from me for study matter and we can prove that easily, would that be an issue for me there with the immigration people ?

 

and btw, we got married on February 1, 2017, so by Feb 1, 2019 the visa should be IR1 as far as I know.

The issue is never to prove you have a good excuse for not living together.  Focus on evidence you have an ongoing marital relationship.  Do the things married people do, including visiting as much as possible and getting both names on leases, insurance, credit cards etc.  

 

Your plan is workable, but it will add complications.  Be prepared to deal with it and then deal with it.

Facts are cheap...knowing how to use them is precious...

thanks man ! I don't know what stronger proof they may need other than having a son together !

but i'll do what you've mentioned as well. thank you again !

You still don't get it.  Having a son together is great evidence you had some kind of genuine relationship at one time.  Removal of conditions is about evidence you STILL have a bona fide relationship at THAT TIME.  If you don't, or they don't believe you do, you will NOT remove conditions.

Facts are cheap...knowing how to use them is precious...
