Hi! 

I just wanted to know the difference between I-134, I-864 and I-864a. To give you a background, I finished a short course/training this May 2018 and got  hired full time at the same month. Previously, I only worked part time since 2014. I understand that the financial requirement for applying k1 visa for my fiancee is 100% of the poverty line then 125% for the adjustment of status. 

 

Since I will not be able to meet the requirement my mother will be co-sponsoring. We live in the same household. This is what I understood from reading forums and the uscis website:

I-134 AOS

- Used during the k1 visa interview

- to be filled out by Petitioner

- And co sponsor?

 

I-864 AOS

- Used when adjusting status after marriage

- to be filled out by Petitioner and joint sponsor if there is any

 

I-864a 

- Agreement between the sponsor and household member to combine financial value

- Petitioner and co sponsor?

 

Which will I prepare for the affidavit of support once my fiancee schedules the k1 visa interview?

a. Petitioner: I-134

Co sponsor: I-134

 

or

 

b. Petitioner: I-134

Co sponsor: I-864a

 

or

 

Is it going to be a strong evidence to use I-864 since eventually we need to reach 125% at adjustment of status?

c. Petitioner: I-864

Co sponsor: I-864 or I-864a(???)

 

I really need enlightenment on this part. I am totally confused. Thank you!

Come AOS, then you both would use the I-864 and I-864a forms.

 

Philippine's embassy is known to not like co-sponsors for K-1 visas, but is always case by case or how they seem to feel that day.

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

Hi Ben&Zian,

 

Yes my mother(co sponsor) and I will be providing the tax returns, w2 forms, bank statements and pay stubs.

Yes, I have read about the case in the Philippine embassy. By the time my fiancee schedules for the interview (estimated would be on Septmber or October 2018)  I will be able to present 5-6 months pay stubs from my current full time job. Since I just finished school and just recently hired full time it will not sum up to at least 100% the poverty line. That is why my mother will co sponsor as back up.

 

I have read that some would accept co sponsors if it's a close relative and when the petitioner just graduated (provided a certificate is available). Do you think we'll get a shot with my current situation?

Recent grads are generally one of the main areas where they accept co-sponsors so you should be fine then.

From other users experience Manila hasnt even been asking for the 134. This can change of course. Your interview is not going to be for a while, so perhaps when its your time they will be asking for it again. no one knows.

 

Also youre interpreting the income requirements wrong. Its not that you have to have earned over the poverty level before the interview. To calculate income you basically take your current income and multiply it by the number of weeks in the year. So if the job pays you over the poverty level annually (regardless if youve been there a year or not) then it qualifies numerically. The issue would be how long youve had the job. If its new it can be considered too new and not established as a stable source. By Sept or Oct it shouldnt be an issue. 

 

Of course having a co-sponsors form filled out and ready to present if needed is always a good idea.

This is keeping my hopes up! I previously said it was a short course/training that I "finished" but I really meant "graduated" (not a bachelor's degree though but still I just finished studies).

I'm really glad I'm wrong about that! I thought the computation is based on the actual income I had this year which was too late for me considering I started May. If the computation will be annual then I will be able to reach the line. Thanks a lot for explaining this matter!

 

I'm just hoping 5-6months will be considered stable for them :)
