Hello All

I thought this would be an appropriate place to post rather than in the AOS section since more people deal with the I-130 app here (I think). So Erin (the USC) was born in Canada and never had a consular report of birth or a citizenship certificate. Rather, she applied for a US passport and was issued one based on birth to her USC mother abroad. So I am curious has anyone else dealt with this when filing an I-130? I am asking since on the I-130 application it specifically asks if she has been issued a citizenship certificate based on birth to a USC parent. I was wondering fi this might be an issue since citizenship certificates are issued by USCIS but Passports are issued by the state department, and perhaps there is little/no communication between the two when it comes to things like immigration benefits??? The instructions for I-130 say that a copy of the passport is evidence of citizenship for the petitioner, but I am worried that USCIS may still insist she get a citizenship certificate first (which can take ages to process apparently)

Anyway maybe I am woryying about nothing, but any help will be greatly appreciated

Nov 25, 2007: Received notice for interview in Baltimore, MD (No touches, nothing online to date)

Jan 22, 2008: Interview in Baltimore, MD. Went well.

Jan 29, 2008: Can finally track I-130 online. Approved.

Jan 31, 2008: Email I-485 "Card production ordered"

Feb 5, 2008: Another email I-485 "Card production ordered"

Feb 7, 2008: Received I-130 approval and I-485 "Welcome to America Letter" in snail mail

Feb 7, 2008: Email I-485 "Approval notice mailed"

Feb 9, 2008: GC in hand....... (Done with USCIS for a few months) YAYY!!!!!!

Oct 22, 2009: Process starts again. Going to mail I-751 to VSC

Jan 26, 2010: Notice of Approval and Card Production for 10-year GC

Feb 3, 2010: 10-Year GC Received

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

Yes, copy all pages (even the blank ones) of the passport as proof of citizenship. USCIS accepts that citizenship was already proven in the passport issue process.

Yes, copy all pages (even the blank ones) of the passport as proof of citizenship. USCIS accepts that citizenship was already proven in the passport issue process.

I've had seen several of these situations. It's a no-brainer. You provide a copy of the passport pages, which are proof of citizenship, and copy of the birth cert, to show where she was born. The Citizenship Certificate is not needed, but it helps to have some documented proof of parent's U.S. citizenship. Edited by alohaspirit
