I think this deserves its own thread as Andrew McCarthy makes some great points about both cases.  To the Moderators, if you believe this needs to be grouped with the other two threads of the specific cases (Manafort and Concord et. al.) feel free.

Judges in Virginia and Washington have the special counsel reeling.

Well sure, we filed an indictment. And yeah, we took a victory lap in the big bells-n-whistles Main Justice press conference. But that doesn’t mean we, like, intended to have a trial . . .

That seems to be the Justice Department’s position on its mid-February publicity stunt, the indictment of 13 Russians and three Russian businesses for interfering in the 2016 election.

 

Let’s back up.

The courts were not kind last week to the Justice Department’s gamesmanship on the Russia probe, also known as the Mueller investigation, an investigation in which the cases prosecutors want to try are not about Russia, and the case about Russia prosecutors don’t want to try.

 

Judge Ellis and the Manafort Case in Virginia

First, in the Eastern District of Virginia, where Paul Manafort is facing one of the two indictments against him, Judge T. S. Ellis hammered Mueller’s prosecutors over the issues we have been hammering for a year:

 

(a) In appointing Mueller on May 17, 2017, Deputy Attorney General Rod Rosenstein failed to comply with federal regulations that control special-counsel investigations; and

(b) The secret August 2 memo, by which Rosenstein attempted to paper over this dereliction, is so facially uninformative and heavily redacted that the subjects of the investigation, the courts, and the public are still in the dark. The factual basis for a criminal investigation is still unknown, as are the boundaries of Mueller’s jurisdiction — with Mueller’s prosecutors paying lip service to the notion of limits, even as they argue that, essentially, there are none.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

That was the jist of what I got as well when I read the WSJ article about this as well. The prosecutors on this case sounded like they were hoping to try these guys in absentia, get convictions, and then do a victory lap against "Russian Collusion". They were left awe struck that the attorneys for these guys suddenly appeared out of no where to represent them and then wanted the exploratory documents that the prosecutor has on their clients.

 Mueller's investigation is finished (If it ever started) and he may be subject to several felony convictions for lying to obtain warrants and other due process violations. Expect to see a new fake Trump scandal in the news soon. People are sick of hearing about Stormy Daniels and Mueller doesn't want any light on his phony investigation for the time being.

Wonder if Mueller’s team will actually turn over the evidence to the defense team?

Seriously we were talking about this yesterday at work when according to DM it was "Breaking News" that President Trump had sex with playmate while her friend watched in wait for it..............1993. 

 

Like I should care that he supposedly had sex with a porn star in 2005. He was not a politician then but a private person and it was consensual. So why should it all matter?

It doesn’t, and it shouldn’t.  Even if it was last week. (Except to Melania; she might have a say in the matter).

That's it -- Trump colluded with the Russians to get their attorneys to do this, to quash the Mueller investigation!  Impeachment now!!!!!

Yes. How dare a defendant actually show up for court to defend themselves and ask for discovery. King Mueller should have them arrested.
