Traveling together: Single Parent and 12 year old Child, and PH Wife (K1)

Timeline

My question is this - 

 

Is there any special permission or clearances or documents needed to enter the Philippines?   My son's mother has notarized her authorization for his passport - he now has his passport valid for another 5 years.

Someone mentioned that I might need some special permission to prove Im not kidnapping him.

 

What the hell.   I mean - his mother had to sign and notarize paperwork for his U.S. passport.   Now we need to drag her to the airport with us or what?   It was pulling teeth trying to get her to get the passport.   I mean its not a comfortable situation us discussing all of our travel plans together and we only need her signatures?

 

I already have the flight tix thru Asiana Airlines for end of June 2018.    Please advise if I will be having any trouble.   It will be the 3 of us:  me, my son and my new wife (just got her 2 year green card from K1 visa)

 

Second question - 

My wife now has her new PH passport with her new married name, she has the green card for 2 years... any problems coming and going back to the PH?

 You are talking your son with your EX wife .. a USC.

 

I would tend to think you would need a letter from your EX (the mother) giving you permission to travel with the child.  But that is just my opinion

Correct.   The son is from my EX-Wife (USC)

 

So - someone else said that... but who is the agency doing the checking?    The airlines?   The PH on entry?   PH on exit?    U.S. Customs and Border?

 

I have a feeling if I call and ask someone they will ask for a blood sample from the other parent as well.

 

What I will do is call them and ask for their policy on parents traveling with children.   This has to be posted somewhere.

Its better to have a letter from her granting permission then find yourself at the mercy of some immigration officer at an unfamiliar airport in a third world country. My opinion also.

Timeline

You need a letter from the mother saying she’s allowing the child to travel with you, unless you have full custody. If you have full custody the court papers will replace the mother’s letter. 

 

The letter will be presented at the US airport. I don’t think the Philippines care about your custody issues (but I could be wrong 🙃).

If a child (under the age of 18) is traveling with only one parent or someone who is not a parent or legal guardian, what paperwork should the adult have to indicate permission or legal authority to have that child in their care?

U.S. Customs and Border Protection (CBP) strongly recommends that unless the child is accompanied by both parents, the adult have a note from the child's other parent (or, in the case of a child traveling with grandparents, uncles or aunts, sisters or brothers, friends, or in groups*, a note signed by both parents) stating "I acknowledge that my wife/husband/etc. is traveling out of the country with my son/daughter/group. He/She/They has/have my permission." See our Q&A parental consent.

 

While CBP may not ask to see this documentation, if we do ask, and you do not have it, you may be detained until the circumstances of the child traveling without both parents can be fully assessed. If there is no second parent with legal claims to the child (deceased, sole custody, etc.) any other relevant paperwork, such as a court decision, birth certificate naming only one parent, death certificate, etc., would be useful.

Adults traveling with children should also be aware that, while the U.S. does not require this documentation, other countries may have a requirement and failure to produce notarized permission letters and/or birth certificates could result in travelers being refused entry (Canada has very strict requirements in this regard).

The above is from DHS.  Personally, I just draw up a simple typed letter stating my name, my husband's name, and my child's name (along with passport numbers) plus the dates of travel and we both sign it.  Sometimes POE officers ask me to show it, sometimes they don't.

US has no such requirement

I believe that part specifically refers to parents from outside countries entering the US....not parents exiting the US with a USC child (which is the case of the OP).  

 

The whole idea behind CBP strongly suggesting a travel consent letter from both parents is to deter parent/child abductions where the non-custodial parent is trying to flee the country with the USC child...not bringing the USC child back into the States.  The letter is suggested to show POE in other countries, depending upon other countries' requirements when children travel with only one parent.

 

I've traveled over a dozen times (to different countries) with my daughter without my husband present.  I've never been asked to present the letter when re-entering the US with a USC child as the US itself doesn't require the letter when crossing back over the US border with a USC child.   I've never been asked to present the letter when boarding the train or plane in the US with a USC child.  I've only been asked to present the letter when entering the foreign country (and sometimes not even then).

The OP isn't leaving the USA and never returning.    The warnings are on the CBP website ... a wise person would heed them.      As the Elvis song says... "wise men say only fools rush in .. "
