OK! So little old me was dating a us citizen, i visited in Sept '17 and we hit it off, we instantly clicked but we knew we would have to take things slow because we would only see each other every three to four months. Three days before i was due to leave (Esta Expiry Date was in three days) my boyfriend took me for a hike in the forest as one of our last few times we could spend together.. he proposed saying since ive been here he couldn't live without me, it would kill him to see me go home again. I said yes. We married two days later, in a little but cute chapel. We had every intention to try even though impossible to file everything within the next week, haha! We were so shocked how much you have to do, but my esta ran out within two days of our wedding and now im here overstaying. i've overstayed nearly two months as ive been waiting for my medical records from the UK. 

 

Am i right in thinking because i came here under intentions of returning home & because the marriage was bona fide & spur of the moment i am able to file for AOS?

 

What is the chance of it being denied & being deported?

 

Any and all help is welcomed.

You'll be fine. Just make sure you file ASAP. I don't wan this to sound like scaremongering but there has been at least one case reported her on VJ where someone got picked up by ICE and told file for AOS or get deported. I've only seen one case of that happening here (might be more) and I am sure ICE has better things to do, but in today's political climate around immigration I really do recommend filing as soon as you can. 

 

The overstay will be forgiven and the paperwork is pretty easy though feel free to ask if you have any questions. There's like one or two questions on there that can be a bit tricky but you can definitively file this on your own. The majority of us have done so without a lawyer and without any issues. Good luck! And I am sorry about your grandfather :(

To the OP, congrats on the marriage, and Good Luck with your further journey.  As other posters have already stated (essentially), take a deep breath, and get your AOS package together ASAP.

I wasn't debating anything, I just put in my 2 cents and gave them advice to file the AOS right away.

Then why bring up an opinion about something that is currently a legal avenue to immigration?

I agree. I learned that if the applicant is a middle-aged adult, most of the shots are not required because they are not age-appropriate anyway. There are really like 3-4 shots required and blood work need to be done for 2-3 stds. and that is it. it is not worth the hassle to track down old records.

Thank you everyone for your advice. We have now got my medical records & will be having my shots & bloods drawn this week & the whole packet for my AOS will be sent by the 21st of this month. Does anyone have any FULL checklist for all forms, documents & evidence that i’ll need to get together for a complete aos. I don’t want to miss any forms or fee’s.

You'll be fine. I'm also British and was in the same situation as you. My overstay was by about 2 months and the whole process couldn't have been more smooth sailing. No mention of intent or overstay whatsoever at the interview and my green card was received within 5 months. Overstay is forgiven with AOS and intent is determined when you enter the US, so you'll be fine. We had hired a lawyer just because we had no clue about any of this stuff, but after going through the process, I realise we didn't need one. All she really did was prepare our forms for us. So you can totally do it on your own.

Double and triple check all your forms before filing. Make sure you are submitting the correct current version of each form. Make sure you verify you have the correct payment amounts and information on your checks / Money orders.

 

I would strongly recommend you make at least one photocopy of everything you submit for your own records and reference (in case you need to verify something).

 

If you submit your medical, make sure the Dr gives you your own copy for your records as the copy for USCIS is sealed.

 

I recommend taking color photocopies where appropriate (passport pages etc...).

 

We separated each form into it's own large envelope and wrote my name on the outside, alien registration # (I already had one) and then an itemized list of the contents of the envelope.

 

If in doubt, ask and there are plenty of people who have gone through the process and can help you out.

You've already done the medical? Columbus seems to be 5 to 15.5 months of processing times, so shouldn't be an issue.

But I've had several clients paying for a second medical report because the first expired before a decision was made on the case. Otherwise, I've been recommending my clients wait until we get an interview date or at least 2-3 months after the biometrics, to avoid that issue.
