It's technically allowed, but there's risk.  They do suspect you may stay since you have filed for an immigration visa.  A friend of mine had had a visit with her spouse who came on ESTA.  They begrudgingly granted entry, but made it known that they weren't happy to do it.

Of course you can try. Anyone can anytime. Will they approve it? Depends on the ties to the DR; but of course can always try.

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

If they already have a B1 VISA there should be no issue using it for short trips. The only issue is if you don't have one and try to get one, that is basically an automatic denial.

they denied the B1 and basically told him to wait on the I130 we had already filed
