B1 visa from DR

I know visiting is allowed but has anyone from the Dominican  Republic had a successful visit on the B1 visa with a pending I130? I'm the USC here in US and people are telling us not to try.

It's technically allowed, but there's risk.  They do suspect you may stay since you have filed for an immigration visa.  A friend of mine had had a visit with her spouse who came on ESTA.  They begrudgingly granted entry, but made it known that they weren't happy to do it.

Of course you can try. Anyone can anytime. Will they approve it? Depends on the ties to the DR; but of course can always try.

Thank you all. I'm not sure what we're going to do yet. My husband spoke to a lawyer who advised against it. So it's going to be a long and lonely road ahead of us.

My spouse has a B1 visa from Colombia. Has never had an issue entering to visit during the process. Has entered 4 times in the last year.

We tried and got denied... my husband had also spoke to a lawyer before trying and was advised against it but I made him apply anyway.

If they already have a B1 VISA there should be no issue using it for short trips. The only issue is if you don't have one and try to get one, that is basically an automatic denial.

Ugh...I'm not going to push it...do they give a reason for denial? Did they deny the B1 or your entry?

they denied the B1 and basically told him to wait on the I130 we had already filed

yes and I'm getting very impatient... 7 months and still don't have an approval yet
