FYI - This morning's look at VJ May timelines says 102/302 I-129Fs at CSC have NOA2, so we're over 1/3 done (and usually things trail off somewhere between 2/3 and 3/4 done, between people not updating timelines, withdrawn petitions, denials, and the handful of petitions that just end up taking a very long time). Still only 5 RFEs.

That's interesting. This person was applying for a K-1 visa? That is the key that unlocks where you will schedule your interview. K-1 normally with Embassy and CR-1 with NVC. Then again, it could be something that is only Colombia specific but what the K-1 P3 letter states which conflicts with your knowledge is:

 

Pay the application fee and schedule your interview at https://ais.usvisa-info.eom/en-co/iv/information/k visa. NOTE: You must schedule two appointments through this online system - (1) at an Applicant Service Center for fingerprinting and (2) at the U.S. Embassy in Bogota for your consular interview. (If you have questions about how to use this website, please follow the instructions on page 3.)

 

So, I think the information is wrong that is being given. You have to determine if the person is a CR-1 or K-1 and that will answer this dilemma. Let me know what you find out.

@debbiedoo is correct in her explanation. I will lay it out a little further. I suggest you share this with your fiancée and your "Agent" who is misinformed. :bonk: Jeez I need to start charging when I am correcting a lawyer, Agent or friend. :jest:

 

To calculate total family income, the incomes of all related family members that live together are added up to determine poverty status. If an individual or group of individuals (such as housemates) are not living with family members, their own individual income is compared with their individual poverty threshold.

 

Thus, all family members have the same poverty status, and some families may be composed of single unrelated individuals.

 

If total family income:

Is less than the poverty threshold for that family -  that family and everyone in it is considered to be in poverty.

Equals or is greater than the poverty threshold -  the family is not considered to be in poverty.

 

Example

 

Situation

Family A has 5 members: 2 children, 1 mother, 1 father, and 1 great-aunt.

Step 1: Determine the family’s poverty threshold for that year

The family’s 2017 poverty threshold (below) was $29,986.

 

Step 2: Calculate the total family income for the same year

Suppose the members’ incomes in 2017 were:

Child 1: $0

Child 2: $0

Mother: $11,000

Father: $10,000

Great-aunt: $10,000

 

Thus, Family A’s total income for 2017 was $31,000.

 

Step 3: Compare the family’s total income with the poverty threshold

 

The total family income divided by the poverty threshold is called the Ratio of Income to Poverty.

Income / Threshold = $31,000 / $29,986 = 1.03

 

The difference in dollars between family income and the family’s poverty threshold is called the Income Deficit (for families in poverty) or Income Surplus (for families above poverty).

 

Income – Threshold = $31,000 - $29,986 = $1,014

 

Conclusion

Since Family A’s total income was greater than their poverty threshold, they are considered not “in poverty” according to the official definition.

Q1 Yes and Q2 Yes. Follow the RFE to a "T". Return the original with your cover letter and court documents. Be sure each is labeled with the RFE # so if lost it can be put back with the "package". Make a copy of everything and keep it for your files. Return back to USCIS with some sort of tracking so you know that it was received and if need be you can prove it was sent.

Please follow embassy instructions on how to get the interview appointment.

Thye will give this information to you and in most cases they have this information on the embassy website

For clarification: 

1. Yes, our group is made by K1 fillers

2.  We get the K1 interview appointment via a webiste that is provided by the American Embassy

3. In the webiste we can choose from specific dates, only.

4. We are responsible for setting the appointment for the interview. 

5. According to the information I got from the group, these dates are set by NVC in advance (in the website provided by the embassy)

6. The embassy is the entity dealing with the whole VISA application process, including giving instructions about how to set up an interview date and requirements and documents.

 

I hope this helps to clarify what I have said before. Again, this was an information I got through a person who spoke direclty to someone at the embassy. The person in question was requesting another date for an interview, it was not possible

The Embassy doesn't set the appointment you do. Follow the links below as it will answer all your questions on what to do, who does what, how long it takes and even more. FREE. Please, Please go over to the sub-forum for the Philippines where there they can answer your questions. Why ask someone from Germany, Norway or the UK of what you should do in the Philippines. It's not logical.

 

Once you receive your case number and your case has been set to READY at ceac.state.gov it's time to be in charge of what time you choose when things get done. To smooth that trail for you I have a few things that will help you process your visa there in the Philippines.

Start by visiting Hanks site where he has taken the time and research, and of course, it helps if you spent 8 plus years helping folks in the Philippines sub-forum get their visas, where he has listed each step. With those steps, he includes the what, when and why to complete the item. Many have used the website and have had little or NO problems securing a visa from USEM.

I guess we will have to agree to disagree.
