Hello guys,

 

I have a concern, I have background history that was sealed and expunged about 7-8 years ago. I am the petitioner for the K-1 Visa but on the I-29F on section 3 under beneficiary information there were questions regarding the criminal background. I received assistance from an attorney when filling out the form and I was told that the information about the criminal background was for the beneficiary not mine. so the answer to the criminal history was NO assuming it was for the beneficiary.

Now I was just reading some threads and got worried because dont know if that will impact the process with a denial or an RFE due to the fact that I the petitioner did not disclose it. I was willing to disclose that information and even got the police records and court record about the offense but the attorney that was helping me said "No worries that is information about your beneficiary not yours". Have any of you heard anything about this? 

Any feedback would be greatly appreciated.

I far as I know that information is about the petitioner but I could be wrong will do some research on it.

In the instructions for the I-129F, "you" refers to the petitioner.

 

Additionally, this paragraph from the Instructions helps to indicate that some of this information may be shared with the beneficiary.  If the questions were about the beneficiary, there would be no reason to share information with them that they would already have:

NOTE: The name and contact information of any person who was granted a protection or restraining order against you, or of any victim of a crime of violence you perpetrated, will remain confidential. However, DOS will disclose your relationship to this person or victim (for example, spouse, parent, former spouse) to the beneficiary.

 

I would worry too :(

I know, and it sucks to be at this point of the process where we are close to find out what is going to happen and if they request an RFE? I just dont know... I guess RFE would be better than a denial. I was just following attorney's advised but my gut was telling me that it was my information not the beneficiary.

Here's the deal. You should contact @John & Rose. He had a similar case but somewhat different then yours. He returned his RFE forgetting about a expudged case as a young adult and he answered his RFE with NO when it should have been YES which caused his denial. I'll let him walk you through it. If you act now you might be able to amend your application with a long explanation with back up documents where needed. USCIS can review this information and included with your case for final adjudication. He would welcome your inquiry so don't hesitate Get'r done!

Wow!!!  Very similar. We were told by an agency that I should say no since I was expunged. Here is the truth...you should answer YES. The I-129f is all about the petitioner. Just like you, my YES would not have made any difference in the petition. It was a misdemeanor battery arrest that was dropped and later expunged. By court order all digital and paper copies of the arrest were to be destroyed and they were. I do have a copy of the expungement order though. 

 

It seems that lawyers know as much about this as the agencies we pay to help do. If you read the actual directions they specifically says that the petitoner should answer yes if they were ever arrested even if someone tells them to answer no or they were expunged. I have a feeling they have seen this before. I would try to amend the petition but I also have to say that since this happened to me I have heard from at least a dozen people in almost the same situation (answered no when they had an arrest) and they were all approved. Your lawyer and my agency were both wrong. It isn’t the end. If you can amend try that. We were approved by NVC. They took my wife’s and step kids passports and congratulated us at the interview but 48 hours later saw that we were refused. It happened after the interview in AP. At some point try to fix that honest mistake and you will be fine. It is more about the disclosure than the actual arrest.

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.
