Timeline

Hey hopefuls,

 

We're also May filers. It's been 105 days, and the end of the wait seems near. We are (m) Texan and (f) Irish who met in Dubai 4 years ago. We've been engaged since Nov 2017, but he lost his job in the M.E. and got an even better one back in the states, so the decision on which country to live in was made lol.  Our i127-F was received May 15. We saw rumblings of May filings moving forward, so we will be stalking these forums and keeping you hopefuls up to date.

 

We're fortunate to continue to spend lots of time together over the past 6 months, but we are looking forward to the day where we can live engaged together for a few days! She's coming to visit Sept-mid Nov, so we're hoping that gets cut short!

I got a hold of the memo and read over it and there is so much in there to explain but it has nothing to do with K-1's. Basically if you are applying for a benefit (visa) and you are not eligible for that benefit or you are not using the benefit for its intended purpose then the adjudicator doesn't have to send you a RFE or a NOID. Just VOID. Done!

 

But if an application is received with an error or missing documentation and is the intended benefit then the adjudicator is obligated to complete the entire processing up to and not including the approval, but must combine all RFE's for that case into one request. If the adjudicator determines that the application is a "place setter" application, meaning they don't have all their information at the time of filling but hey USCIS will send an RFE and then I can respond with my missing documentation that I now have.  In the past they may send out a RFE letter then two weeks later send another RFE for a totally different circumstance tied to the original submission. The memo requires them to ask for everything in one letter.

 

So there are many good things in the memo. One just has to take the time to read for themselves and not rely on CNN or Betty Lou over in the Jamaican thread who is afraid that the sky is falling in on her K-1 visa with the intent that she is going to get denied.

 

Believe it or not the spirit of this letter was promulgated in the Obama Administration. This administration is only trying to get the rules so that they are followed. There isn't anything in there that is made up without a reason now or from the past.

I have a friend that is on day 198 I believe and her visajourney timeline says Aug 17th for some kind of notice. Shes super bummed. I told her it will come!!  That's a long time. Her fiancé is in DR.

Hey everyone! I saw that someone here posted about the new site and that the apps are not updated by the new site. My app says NOA1 4/30 and that I am on 115 days today. The new site says my NOA1 is 5/3. I received the text from USCIS on 5/4. So, I should be going by the 5/3 date and I'm actually on day 112?

you are really putting more thought into it than you should. dont sweat it. 

 

regardless, USIS will get to it when they get to it, no matter how many days it's been ....

I have a quick question, What happens if your foreign fiance is not currently working. would that be a reason why they can denied the application? I am a little bit concern since apparently that is one of the question in the interview. Please advise.

No, the beneficiary not working will not be a reason for a denial. If the petitioner wasn't working (and lacked significant assets or possibly a cosponsor) it could be a reason for denial due to public charge concerns.

 

But the beneficiary can't work immediately anyway, so it's not going to be a concern that he or she wasn't working before.

Hello May Fillers! My fiance is a licensed vocational nurse. My fiancee and I are waiting for our second NOA. My 2015 employer is having difficulty finding my w-2's for that year because of management change.  If they can not find them, will we be okay with just my 2015 tax return from the IRS for her interview at the U.S embassy in Manila?

download your tax transcripts and send those. w2's are not necessary. they are most concerned about current/ongoing income, anyways.

Probably not.

It's currently looking like November or December NOA2s for most of us, probably (our timeline is projecting first week of December, but we're last week of May). And seems to take a little over a month from NOA2 to NVC to consulate on average. So I suspect even those of you in countries where you can get interviews very quickly won't be interviewing before January. I'll be pleasantly surprised with anything before April out of Moscow (where average time from arrival at consulate to interview is about 3 months right now).
