As I wrote on my previous post, my fiancé and I submitted our paperwork on March 30. We hadn’t heard anything until Monday last week (April 30) that said it was on “pending processing.” Yesterday (May 7) my fiancé came to USCIS office in Dallas to get the update since we still hadn’t heard anything. They said my fiancé had a year of unpaid taxes. I asked him why he forgot and he said he didn’t remember about it because it was years ago. I know nothing about taxes. Will it affect our k-1 visa process? Does he have to pay everything before they approve our paperwork? Please help because we’re getting so frustrated. We’re not used to being so far from each other this long (it’s been almost 4 months). If anyone can explain, please help us. Any kind of explanation is appreciated. Thank you.

Yes. The taxes have to be paid. 

 

Also, what did you guys expect to hear after two months? :P I mean I understand you wanted update but people don't generally go and bother Uscis offices. Be patient because k1 process can be as long as 10 months or more.

We haven’t even gotten NoA1. My friend submitted her application 3 weeks after ours but she has gotten her NoA1. I’m glad he asked though. We wouldn’t have known what is going on with our paperwork if he had not gone there

No. They'd would send you both noa1 and probably rfe.

Well the normal route would be to wait for rfe.  You don't reapply unless your paperwork will be officially returned to you. 

 

But I'm sure others will know better than me. :P I'm not exactly sure. So wait for someone else to answer also. 

 

It's just unusual for anyone to go for updates to the office..  hence weird situation.

I'm assuming that OP meant the USC had an infopass appointment, maybe?

This doesn't make sense. I don't know why USCIS would know that your fiance had not paid taxes, especially if it was years ago. I also don't know why it would care at this stage. It would also not be the reason for you not getting a NOA1. Taxes are more of an issue when the application is at the embassy, and you should bring his recent tax returns to the interview (along with the I-134).

Forgive me for being perhaps insensitive, but reading your past posts... your fiancee seems to forget things a lot, lose things a lot, not follow through with evidence a lot...

 

Are you sure he's not just lying to you? Is he really taking this seriously?

Facts don't make sense...  The USCIS field office would not be able to help nor are they charged with collecting unpaid taxes.

 

It is amazing that the OP's USC magically remembered something from sooooooo long ago

I read your past thread too....I''m starting to wonder the same thing...he has no record of payment for the K1 filing to share with you, he claimed to lose other documents when you asked him to send them to you, he doesn't submit other stuff, now this tax thing....

 

Perhaps you need to talk with him and find out where his head is at in this process?
