:unsure: Hi everyone,( yes, lol I am new)

My husband and I were married on March 2nd of this year. I am in the U.S. and he is in Turkey. We are going for the k-3 and I filed the I-130 three weeks ago to the Texas Service Center and have still not recieved the I-797. I read the guide and according to what it said it usually takes two weeks. Just was wondering if I need to be concerned yet, and how to go about checking on it. Any advice would be appreciated. Thanks so much.

You should not be too concerned yet, you sent it to the Texas service centre, your application will get transferred to the California service centre. Once it is there the Cheque that you sent will be cashed, look on the back of it if you can and you will see a set of numbers starting with WAC 0705200000000 if not then wait for the NOA1 which will give you your number.

Once you have this go to the USCIS web site and register. You will then hopefully get updates via e-mail or what we on VJ call Touches (these you may get without any e-mail.)

yep .. find out the number from the back of the cashed check then click the USCIS/Touches link in my signature to enter that information and find out your NOA-1 (I-797) date of receipt and if you have received any "touches" (these are just date changes, no actual information otherwise until approval).

Hi

The RFE was for parents names on the birth certificate (I have to go to the registars office on Tuesday)

This is to confirm that I am the birth mother of my daughter, on the birth certificate that I have for Alarna there are no parents mentioned which is the norm for England because I was never married to her father. I am also going to the Doctors office and asking them about it too.

There was a thread on this issue on about April 19. In that thread, Yodrak noted that what is required to file a I-129F petition for a spouse is evidence that you've already filed the I-130. The I-797 issued in connection with a I-130 is probably the best evidence you can have. But USCIS hasn't been timely in sending these out to lots of people.

Did OP or her spouse send the I-130 packet with delivery confirmation? That is, can it be shown that USCIS got the packet? Has the check been cashed? Is the receipt number clearly legible on the check? Did the check mention anything about an I-130 in the memo line? With many banks, you can get images of checks online or returned to you by mail. Perhaps these alternate items of documentation will go a long ways to demonstrating that the I-130 was in fact filed.

I know what you mean. It took over 2 months for us to receive the NOA1 for the I-130 and that's why we decided to pursue the CR-1 instead. Many people have said that if you have your receipt # and are sure that what you have is the correct #, then that is all you need to file the I-129F, but my husband and I didn't want to risk it. I think it actually turned out to be a better choice for us since now we don't have to deal with the hassle of AOS and EAD once he gets here.

If you still have the carbon copy of the money order, there is usually a 800 toll free number on it. In some cases thwy can inform you if the money order has cleared. I lost a money order in the past and customer service was very helpful in tracking the money order for me. It's worth a try.

I did not see a number on my cashed check, but I called, (went past the 30 day waiting period prompt, even though it hasn't been 30 days yet) and asked the representative to look up our petition by my last name. She told me then that the petition has been received and gave me our Case Number over the phone. She also requested a copy of the 797 to be sent to us. [i never received the original copy, it was probably lost].

So your best bet is to call and ask!

and was told by the machine that application reviews will take four effin weeks

which means we have to wait for two more weeks before we start making calls to california regarding our application
