Hello Everyone

 

I am at the interview phase which should be very soon,

I got CC'd from the NVC with taxes up to 2016, but for the 2017 taxes my joint sponsor filed for an extension and he sent me this copy and told me he has nothing else, will that be ok during the interview ??

Yes, that should suffice in place of 2017 tax forms since it is proof of extension of his tax filing deadline...

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Yes, it is proof of having  filed IRS form 4868.

Consular Officers are not interested in a sponsor's "excuse" for not yet filing their 2017 tax return.  In my opinion, the choice to file an extension is a bad choice during a year you are trying to sponsor an immigrant.  Extensions don't extend the time to pay taxes.  They just give taxpayers and/or tax preparation professionals more time to do their work.  My advice is to file the return if not before filing the I-864, do it before the visa interview so the immigrant can take a copy to the interview.  

 

If a Consular Officer wants to see the 2017 return, evidence of filing an extension won't help in the least.

Facts are cheap...knowing how to use them is precious...

If the extension wont work .. why did they mention it in their website??

they could have said that an extension is not acceptable .. i have his filings for 2014,2015,2016 and he always pays them in october of the year so he always do file for an extension ..

How do you get this letter? .I have also file tax extension because of my wife did not have tax id number.

Filing an extension is legal.  It's just not a good idea during the year you are sponsoring an immigrant, for the reasons I already gave you.  Whether it will be a problem depends on the rest of the relevant circumstances.
