My wife received I797 Notice of Action to extend her conditional residence status for one year.  The I797 receipt date was 03/13/17.  Her conditional green card expiration date was 06/09/17. 

 

So is the one year extension for receipt date of 03/13/17 or is the one year extension from green card expiration date of 06/09/17.

 

She is currently out of country and set to return on 05/15/18.   She is now paniced that they will not let her back in US.  So if anyone has explicit experience with this, an urgent response will be appreciated.

Check her I797 - the more recent ones explicitly state that it's a one year extension from her green card expiration date but she needs that paper as proof to be admitted back to the US.

Also, while she's out of town, you should start trying to see when you get schedule an Info Pass appointment to get an I551 extension stamp. She'll need that to reenter again or for proof of work eligibility.

It is to the date of the GC expiration, she should be fine returning prior to 6/9/18.  As @GreatDanementioned, start looking for infopass appointments to get the I551 stamp to extend it another year.

It's one year from the expiration date on the existing green card.

That said, sometimes it can be difficult convincing a carrier that the green card is still valid with just the extension letter. But once boarded and brought to the US, it shouldn't be an issue.

Thanks to all for timely response.

 

The specific wording on I797 is "Your conditional resident status is extended for a period of one year"  It does not reference the notice date nor mention the green card.  For me it is a no brainer.  GC expires on 06/09/17.  The notice extends the status one year to 06/09/18.  She has GC and original I797 with her.  If I thought there was a problem, I never would have let her go out of country.  But she is now in China and read on some China immigrant website that some woman went to some USCIS office in Ca and the officer told that woman the one year is based on the receipt date on I797 - not GC.  This may be true story but I do not think that makes it correct.  So my wife is in panic and wants me to resolve this for her definitively.  I will call USCIS but who knows if I can get a straight answer.  For now I am just trying to calm her down.  I want her her to enjoy her time with family.

 

We were in Egypt and returned on 03/11.  Airlines did give us a hard time but because I forgot to bring the original of I797.  I only had a copy.  Airlines supposedly called consulate for clearance.  So it was approved and then we had no problem changing planes in Munich (they checked GC again) nor when we returned to Chicago.  But I agree with you guys that with right document she should not have a problem.

 

I do have an appt at local USCIS to see about getting an extension on the extension.  Appt is on 05/17. I think that will cover us another 6 months,  N400 paperwork will be submitted in next week.  It is all prepared and ready to go.

If anybody has specific experience -  like just came back under same condition, I would certainly appreciate to hear.
