My husband's EAD card expired January of this year. Unfortunately, we were not paying attention and we have yet to send in our form to renew it. What can we do? Is he still allowed to work with an expired EAD card. Can he travel?

AOS from F-1 Visa

01/12/2017: "New Card Is Being Produced" I-765 [Day 99]

He has to renew it to be able to keep doing so. If he leaves the country under an expired AP, he won't be able to get back in. 

K1 Visa Process

April 2017 - NOA2 (6 months!)

April 2017 - Arrived to NVC

April 2017 - Got the # from NVC

May 2017 - Case left NVC

May 2017 - Arrived to Embassy

May 2017 - Got Package 3 

May 2017- Got Package 4

May 2017 - Interview [APPROVED!]

June 2017 - Visa arrived home

June 2017 - Made it to the US. Finally with my future hubby!!

July 2017 - Married!

AOS Process

August 2017 - Started AOS

August 2017 - NOA1

Sept. 2017 - Biometrics

19th Dec. 2018 - Interview date  [16 months]

Dec. 2018 - GC processing

29th Dec. 2018 - GC arrived home! [10 days!]

If he has his EAD/AP combo card expired then of course he should not work or travel. That is why it's convenient to renew it at least 90 days before expiration to avoid this gap and because this is the time USCIS need to process your renewal.

 

Is he still working with an expired EAD? Did he file for renewal of the EAD/AP already?

@OP - according to your timeline your husband has GC in hand? If that is true, then his EAD/AP became invalid on the day he received GC and GC serves as his work permit and trevel authorization (as well as permanent residency 'certificate').

 

If he doesn't have GC then yes, he should not travel and probably work. There is a grace period (I think 90 days?) but you should get on renewing it ASAP. (again, if he doesn't have GC).
