ok so do i need the i864 for the k1 interview to prove his income, and also like when we apply for k1 visa it says 100 percent of the poverty line, and then 125% after marriage, does the 125% take effect immediately the moment we get married, i know i have to adjust status within the 3 months, its hard to put into a short answer my exact question, basically i mean from the day we get married how long do we have untill the poverty line goes upto 125%

Well the GC interview will not be for a very very long time and that is when you need to show the 125%.

so like a year after getting married or somthing? and thanks for answering all my questions by the way, :) also, the marriage itself does it have to be an expensive white wedding or is it ok to just have a civil marriage with a few family present and just sign the papers, we plan to have a proper white wedding when we are older (like with the expensive dress and stuff)

I am not going to guess processing times this far in advance but certainly will not be quick.

 

Wedding just has to be legal.

If it makes you feel any better my hubby, then fiancé met in September 2012 and filed in February 2013. When he moved here we lived with my parents for almost a year before getting our own place. 😊

I will answer as in my opinion:
1. I was dating my boyfriend for less than a year when we applied for the K1 visa. Everything was fine and we got approved without RFE's. If you send everything they ask you to send and show enough proof, this is more than enough. I remember I showed them tons of pictures from trips we did together and me staying at his home with his family and he with my family in Spain.
2. I see you guys met. With that said, mainly show pictures, airplane tickets, hotel reservations etc. I went on a couple of trips with him while dating and I came to the US 3 times (each time for almost 3 months) and he came to Spain 3 months as well. With that said, we showed EVERYTHING we had. I took pictures with his family plus their family took random pictures as well on different occasions like Christmas or Thanksgiving that I used to show that their family took pictures of us as well without us asking. As well, we showed them pictures of our trips with proof of hotels, flights, etc..I had letters that he sent me and presents that I showed pictures.

3. Even though my husband has a job, we are trying to save money. With that said, when we came here we started living at his home a.k.a his mother's home. I told them in the interview that we would be here to save money to move directly into a house asap. With that said no, it won't be a cause of denial.

Nov. 2016 - NOA1 

April 2017 - NOA2 (6 months!)

April 2017 - Arrived to NVC

April 2017 - Got the # from NVC

May 2017 - Case left NVC

May 2017 - Arrived to Embassy

May 2017 - Got Package 3 

May 2017- Got Package 4

May 2017 - Interview [APPROVED!]

June 2017 - Visa arrived home

June 2017 - Made it to the US. Finally with my future hubby!!

July 2017 - Married!

AOS Process

August 2017 - Started AOS

August 2017 - NOA1

Sept. 2017 - Biometrics

19th Dec. 2018 - Interview date  [16 months]

Dec. 2018 - GC processing

29th Dec. 2018 - GC arrived home! [10 days!]

One of the advantages of going through London is that they also allow you to self sponsor. Pretty easy Consulate.

At what stage sponsorship will be required ?
Because I didnt know this. I am going through Kyiv, Ukraine Embassy...will I need sponsorship or can I do self sponsorship ?

Thanks that helps alot :) we are going to apply on our 1 year anniversary, then hopefully get married on our 2nd year anniversary of the day we met on 16th august :P

Awe! We did something similar to that 💜 We got engaged on October 3rd and married a year later. The visa process worked in our favor 😊

1. The amount of time you have been dating is not as important and the proof that you all have spent time together in person and that your relationship is genuine.  A year of dating will not be an issue, especially in the London embassy.  My husband and I met August 2015 online, started "dating" officially in June 2016 on his first visit over, got engaged and applied for K-1 in December 2016, married August 2017.  So we got married 2 years after meeting.

 

2.  The income technically only has to be 100% for the interview stage but obviously the more the better.  If his parents are willing to be joint sponsors, I would plan to bring their information as well.  It may not be needed but better to be safe than sorry.

 

3.  You can send screenshots of conversations but they will be looking for things that put you in the same place at the same time.  Send airline tickets, passport stamps, receipts from things you did while together, hotel receipts, pictures (although this is secondary evidence), etc. 

 

4. Living with his parents is fine.  Just remember though that everyone in the household will be taken into consideration for the poverty line that has to be met.  Someone can correct me if I am wrong but this would make it a 4 person household, not 2.  You are also not required to file for AOS within 3 months.  You are only required to marry within 2 months.  I would recommend applying for AOS as soon as possible to keep you from being out of status but you do not have to.  :)

Wait so everyone in the household counts there is his parents and his sister so including me and him it would be 5, does that mean he has to meet the poverty line to support 5 people even though they all have full time jobs and support themselves?

Actually, you are required to marry and file AOS within 90 days of arrival  to avoid illegal status in the US.  While it not common, there has been an increase in ICE knocking on K1 immigrant doors to warn those who did not file AOS within 90 days.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
