WHen you get married you are allowed to change your last name to your husbands last name. You can not change your first name or middle name. You can also add his last name to yours and have a hyphenated last name. You need to decide what name you want to use. Its a personal decision.

 

If you want your last name to be his and you want to stop using your previous last name you will fill out the AOS packet with his last name in the appropriate name spots. (or whatever hyphenated name youd like_) They will issue you EAD and GC in that name and change your name in the SAVE databases. When you get the EAD in his last name you can go down to SSA and get a new card with the new last name or an initial card with that last name. You then use the EAD and SS card to obtain or update your drivers license.

 

If you submit the EAD/AOS forms with your maiden last name all the documents (EAD and GC) will come with your maiden name. Therefore all the subsequent documents like SS card and DL will be in your maiden name. To change to his last name at that point you will need to pay apx 600 for a new greencard, go back to SS with it and motor vehicles and update the name. Or you can wait until ROC (2 years from when you get the GC) to change it on the GC then. 

 

Ah, so sounds like its better to use his last name now then.

As Im from Hong Kong, we don't really have a middle name. In my case,  my last name is AAA, my first name is BBB CCC DDD. Can i make my last name become my middle name, and my husband last name as my new last name?

Also cos my signature on the marriage certificate i sign with my last name, do i need to change my signature? if so then the signature will be different from the forms for the USCIS, will that be a problem?

Please do not post your real name in the public forums. Its a safety/privacy issue. If you cant edit your post click report post and have a mod edit it out.

 

I have seen people use their maiden last name in the middle name field. Its traditional in the Philippine culture so Im assuming USCIS wont have a problem with you filling out the forms First name/maiden name in middle name field/ husband last name in last name field.

 

On the marriage certificate you sign with your current last name )(your maiden one) so thats fine. On the AOS/EAD forms sign with your name as you entered it on the forms. Once you submit the forms you can consider that your new name and siggn everything that way. Some banks/insurance/legal issues will want to see your new SS card or drivers license to update their records with your new married name. Some places may take the marriage certificate as proof of name change like perhaps your library card, but most places want to see the updated SS card or DL.

That's perfect! I'll go for the new last name then. Was so worried about i need to go to the courthouse do some application before i can use my husband last name.
