Hello All,

 

Has anyone brought their Parent(s) over to the US by sponsorship?  

Called USCIS but sometime it feels like I'm taking to a wall. :wacko:

I've been reading online but not getting the answers I need.  I am a US Citizen and would like to sponsor my mother over.  

 

My Questions:

1.)  Can she still apply for a tourist visa while applying for her Form I-130 (Petition for Alien Relative)?

2.)  How long did the process take?

3.)  Just throwing this in but has anyone petitioned their sibling? (I'm assuming it takes longer than Parents).

Siblings take like plus 10 years. 

Here is like 0 chance your mom will receive the tourist visa while in the 130 process. It's possible but hard since she shows immigrant intent. 

 

Process takes a year, I believe. Just follow the guide

06.02.2014 - NoA2

01.04.2014 - Interview. 

AoS

03.2015 - AoS started.

09.2015 - Green Card received.  

RoC

24.07.2017 - NoA1.

01.08.2018 - RoC approved.

She can try for a tourist visa. It shouldn't affect any future visa petitions. Keep in mind that it may be difficult for your mother to obtain a visitor visa if she shows immigrant intent. Also, If your mother gets a visitor visa, she can't use it to live in the US. If she is spending too much time in the US she could be denied entry.

 

Siblings from Philippines take over 20 years.

1. Yes, you can have multiple petitions open at the same time.

2. B2 tourists visas don't take that long actually maybe a month if that. If you want to bring her over to actually live with a green card it is 12-14 months once you have your US Citizenship and then file.

3. Sibling petitions for the Philippines are taking roughly 16-18 years na, and yes I am being serious. I had a coworker from my last job who petitioned all 3 of her sisters and they all took that long.

Actually, my Mom was denied a tourist visa last year because she lacked a document during her interview.

 

I’m stuck with the dilemma now of:

 

Scenario A:

having her reapply for a tourist visa now that she has that document and hoping 

she will finally be given the visa then apply for the I-130 sponsor.

 

Scenario B:

apply for the I-130 sponsor and praying they won’t take the tourist visa denial into account.  This route would obviously save us in costs (roundtrip cebu/manila + fees) but with the unknown risk of her potentially not being able to come here at all 😭😱

 

Am I overthinking? Any thoughts or experiences?

What does your nanay want to do na, does she want to live in the USA or in the Philippines?

 

If you have the proper paperwork then you can do Scenario A if you want.

Scenario B is also favorable bar something buang then more than likely she will be approved for that visa. The only thing that can bar her from coming with this is if she has a criminal history, what would cause a delay is if she has TB or not.

 

I think you are overthinking just alittle bit in all honesty but it's glad that you are thinking of different aspects of everything.

If you want her to live here scenario B is the route, unless the tourist visa was denied because of a criminal record it won’t impact I130.

That's why I laid out what I did and I think she is going to just bring them here for good.
