Hi,

Our case has been approved on April 3, 2018. My fiancé used to work in Thailand but moved back to the Philippines in March but the NVC is sending the petition packet to Bangkok, Thailand even though we put Manila as the embassy/consulate where my fiancé is going to apply for the visa. I have already received the NVC Case Number.

What should we do before the interview? 
Should my fiancé travel to Thailand for the medical and interview or request a case transfer from Bangkok, Thailand to Manila, Philippines?

If she still has a residency in Thailand she could go do it all there; but honestly I would ask for a transfer to Manila. It's a very easy process through the embassy in Manila even compared to Thailand's. It may delay things a little but during that time she could do medical, CFO, get NBI clearance, CENOMAR, ect.

Does Bangkok accepts cases when the applicant is not a resident?

 

if it does (I am not sure it does..they mostly don’t) the choice is yours. If it doesn’t you’ll need to ask for a transfer.

No, he does not have a residency status in Thailand. He worked there but he went back to the Philippines when his contract expired in March so we could process it in the Philippines. 

 

Do you know how the case transfer process from Bangkok to Manila works? How are we going to start?

I believe you have to contact NVC and request a transfer... im not entirely sure but @geowrian may know the process. Or perhaps @cyberfx1024 .

Yes, you have to contact the NVC in order to request a transfer to the specific embassy where you are a resident at now.

Yes, but when we check the NVC case number that has been given to us, it says that the case is already in transit. Do you think NVC still has control over our case considering it's already in transit?

Call the NVC and have them to transfer it to Manila once it arrives in Manila. This is pretty simple to do just lay it out for them to do, and it happens a lot for Pinoys going from the Gulf back to the Philippines.

If NVC still has the case, you can try to get them to update the address and send it to Manila. Personally, I had no luck doing so after over a dozen calls, but it would be the fastest option.

 

If NVC sends the case to Thailand, then you need to request a transfer. the process to do this would be:

1) Wait for Thailand to get the case

2) Contact Manila and request that they transfer the case from Bangkok. Provide the NVC case number plus both the petitioner's and beneficiary's full name and DOB. Manila will only accept this request via email (or the cgifederal.secure.force.com website once logged in).

3) Wait for Manila to get to your request. Assuming they read it properly (it took 2 tries for us), they should request the transfer from Bangkok and notify you of doing so.

4) Bangkok approves the request and starts the process of sending the case to Manila.

5) Manila receives the case. Note that the case number will not update (Manila cases usually start with MNL in the case number).

6) Process everything else just like Manila. I suggest carrying a printout from the CEAC website showing that Manila has the case...I forget which one it was, but either SLEC or the GCP (CFO) people initially thought my now-wife was trying to go through the process in the wrong country. I think it was SLEC as CFO shouldn't care, but I'm not 100% sure which one it was.

Thank you so much for the info, but how many days will it take for the embassy before they send the packet (with the instructions and everything) to the beneficiary after they received the case from the NVC?

Transit from NVC to the consulate normally takes a few days to a week or so. How long it takes the consulate to process it and send packet 3/4 varies from consulate to consulate. I am not familiar enough with Bangkok to answer that part.

Manila usually sends a notification within a couple days of receiving the packet. The notification includes a link to the USEM website describing the process and materials needed prior to the interview and for the interview (they don't send or request a packet 3 before the interview).

The time it takes to do the transfer depends on the embassies involved. My 2017 case from Riyadh to Manila took about 2 weeks. YMMV.

We are just worried that the US Embassy might already send the packet to the beneficiary (if the US Embassy in Bangkok does send it) before they get the case transfer request from the US Embassy in Manila.

What does the beneficiary need to prove to the US Embassy in Manila when he sends them the case transfer request that he really needs the case to be transferred to Manila? Thank you.

Riyadh sent the packet 3 to my now-wife, but we transferred the case after that anyway. So long as you haven't interviewed yet, you should be able to transfer the case.

They need to prove eligibility to interview in Manila. Namely, either evidence of residency or citizenship in the Philippines. My wife used a scan of her passport's bio page since she is Filipino. The reason why doesn't really matter, but we very briefly noted that her contract in Riyadh had completed and she would be completing her exit in the country on x/x/2017, and returning to her home at xyz in the Philippines until her planned entry into the US on the K-1 visa.
