First off, I am so sorry you are going through this. Our K1 visa was denied several years ago, so I know the pain and devestation you must be feeling right now. 

 

In my opinion, I don’t think they would have denied you solely on finances. If they were concerned about your level of income, they would have stated that during the interview and given you an opportunity to get a joint sponsor. 

 

I have a couple of questions. You don’t need to answer them for us, though that would help figure out the reasoning for the refusal. These are just things for you to think about. 

- Was your husband asked any question more than once during the interview? That tends to be a clue of what the CO is concerned about.

- You mentioned an age gap. How large is it? There are many on this site who have an older female petitioner and younger male beneficiary who have been denied in Ghana. Thats not the only reason, but since it goes against the cultural norm it adds an extra level of scrutiny. 

- How many times have you traveled to Ghana? Time spent together in person is like gold to this embassy is like gold. 1 trip followed by petition won’t cut it at this embassy. 

- Did you get married on the first trip? Again many people on this site denied for that very reason. 

- Has your husband ever applied for a visa or had someone petition for him? 

- Did you frontload with quality evidence? And if so, what did you include? Ghana is one of the most difficult embassies in the world. If you look at my timeline, you’ll see the type and amount of evidence it took for our CR1 to be approved. 

 

Again, I am sorry your dealing with this. I know its difficult.

Sigh...This is so heart breaking. We will continue to try.

-I will all my husband about the questions he was asked during the interview. I will ask if there were any repeated questions. From what I remember the CO did not ask many questions.

-I'm 10 years older than my husband. I know it goes against the norms. Trust me it was not my plan to marry someone younger, lol.

-I lived in Ghana since 2014 until 2017. We worked at the same school so we have known each other for 2 years before we dated. We lived together after getting married. We have an 8 month old son.

-I came back to the States for 3 months and then went black to get married. Most of my family flew over for the wedding.

-He's never applied for a visa. He didn't even have a passport until we went on our honeymoon in december 2016

-we have a joint bank account in ghana. I put pictures of our wedding.pictures of our son. His birth certificate. Letters from friends and family. A letter from a possible employer. I can't remember what else now. 

Hopefully when he gets his passport back next week there will be some indication on why we were denied. He seemed so positive after the interview. All they asked for was my tax info. I will take a look at the evidence you had so we can prepare more. I'm thinking maybe I will move back to Ghana for a while

If your husband evaded questions during the interview the way you are doing here, that would be reason enough to refuse the visa.  There may well be a denial sheet he is given that will shed some light on the problem.  Spouse visas are seldom denied when people have live together in the same country as long as the two of you have.  Your description prompts some more questions and the same ones you haven't answered.

 

Was your husband married before?
Does he have children?

What is his relationship to the mother, if he has children.

What is your age?

What is his age?  (different question than the age difference)  It matters.

Facts are cheap...knowing how to use them is precious...

What questions have I evaded? You don't have to be so abrasive. I'm trying to muddle my way through this just like everyone else.

When he picks up his passport on Tuesday we will see if there is a denial sheet and what it says.

-my husband was never married before

-He has no other children. Just our son.

-I am 41, he is 35.

It seems as though there isn't much more you could have done differently and you will get all points of reasons for refusal in the NOIR letter which you can then address. Sometimes COs just get it wrong and their speculative and assumptious minds refuse genuine couples. That's why USICS reaffirms most cases we have seen come through Ghana. Moving back for a year or two sounds great as it will likely take that long. Don't miss the NOID letter while you are out of the country and have someone watch the mail for you and inform you that it came so 

you can write your rebuttal and include plenty of more evidence

and get reaffirmed. Truly sorry this happened and wish you both the best ! 

P.S. you did say you were 10 years older than your husband but then said 35 and 41 which is 6 not 10.

But you have a child together so it shouldn't be a reason for refusal.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Has your husband gotten his passport now? And what was their reason for the refusal?

     They said he would be a public charge because they said even though I met the financial requirement I was close to the poverty line. I wrote them and let them know it was because I was on maternity leave most of the year. I exceeded the financial requirements on the previous years. I included a joint sponsor and a recent pay stub to show that I met the financial requirement.

They also wrote and told me that I have a Class B medical condition. I have no idea what that means or what that could be. I sent them a copy of my most recent physical which shows everything is ok with me. I am now waiting to hear from them again.
