Did you send only the I-864A or together with your I-864? If you live together, you are supposed to send the I-864 on your name, listing your mother as household member, and then also send I-864A.

How many people are in your household count? If your mother filled out I864A it should be 3? your mother, you and the beneficiary.

Originally I sent in the I-864 for myself, as the petitioner / sponsor . Then I sent in a seperate I-864A for my mother , as contract between household member and sponsor.

 

Now they are asking for her I-864.  I got confused and called them and they confirmed that they needed her I-864 and not I-864A.

My guess is you put in 2 as your household number. Thats why they want your mother's I864 as a joint sponsor.

I think that was the problem. When you check the instructions for the I-864, Part 5 item 7, it says "Item Number 7. This question gives you the option of including certain other non-dependent relatives who are living in your residence as part of your household size. Such relatives may include your mother, father, sister, brother or adult children, if they are living in your residence. However, the only reason to include these relatives in your household size is if you need to include their income when you calculate your household income for purposes of meeting the income requirement for this affidavit. To be considered, any relative included in this category must sign and submit Form I-864A, Contract Between Sponsor and Household Member."

 

Then, in the instructions for I-864A, it says: "Form I-864A, Contract Between Sponsor and Household Member, is an ATTACHMENT to Form I-864, Affidavit of Support Under Section 213A of the INA. A separate Form I-864A must be used for each household member whose incomeand/or assets are being used by a sponsor to qualify. This contract must be submitted with Form I-864."

 

Therefore, you had to put your mother as a household member in item 7 of the I-864, add her financial information there, and submit together the I-864A. As your I-864 was done only on your name, without counting your mother as a household member nor including her income in your I-864, then I-864A does not apply and they are asking for an I-864 for your mother.

I am assuming that you have added your mother as a joint sponsor. Unless she is your joint sponsor, NVC won't as for her i864. For joint sponsor, she has to have her own i864. And if she files her taxes jointly, the spouse should fill i864 A.

So I have received our confirmation letter I-797 from USCIS stating that my information was sent to the NVC on 3/23/2018.  I contacted the NVC several times and they told me that they had 8 weeks to process and assign a number.  I called on 5/24/2018 and they stated they had until midnight of 5/25/2018 to get it complete and that I should call back the early part of this week for information.  I called on 5/29/2018 and was told to call back using Option 5.  Evidently my case has been transferred for "electronic processing" and they stated that the date they received it was 5/29/2018 and that they had 8 weeks.  I explained that their 8 weeks was up on 5/25/2018 and that the case had been transferred.  I was then told they would change the date, but it would require supervisor approval and that I should call back in a couple of days to check.  I called this morning and was told that they are moving "batches" over to "electronic processing" and that ours was one of those.  The supervisor can change the date and expedite it, however, the supervisor has 6 weeks to complete this.  I'm really frustrated at this point and not sure who to scream at.   It seems absolutely ridiculous that they can state that they have 8 weeks and when they can't meet that deadline, move it to a different department to extend their time.  Then to take up to 6 weeks for a supervisor to expedite this is just absurd.  Has anyone else run into this issue, and if so, what did you do?  Thanks for any and all help!

Thank you everyone for your replies. I double checked my original I-864 and for part 5 item 7 , I put in “1”.  “1” being my mother and I attached her I-864A and sent it to the NVC. I supposed this would be correct but they are asking for her I-864. 

 

I’m sorry for asking too much but am I missing something ?

your household number should be you (sponsor) + beneficiary + your other household member that you use to qualify.

I think you should give them what they want, and submit your mother's I864. So now your mother is a joint sponsor and not household member, even though you live together.

On your mother's I864, her household number should be: your mother + beneficiary+her other member of her household member that she'll use to qualify. Except if she's married/have dependents than those persons have to be included as her household as well.

I will give them what they want being my mother’s I-864.

 

I checked my original I-864 and based on what you and the other gentlemen said , my household number is “3” and for part 5 item 7 is “1”.  That being said I believe myself, my mom, and the beneficiary is accurately accounted for.

 

I think I will also include another copy of my 

I-864 and my mother’s I-864A along with a letter explaining this whole case.
