Can B2 visa be revoked before it's used because of new court process in home country

Hi everybody,

I live in USA and I'm trying to get my parents and little sister to come for a visit in usa, they are already approved for their visitor visa since they have strong ties to home country and they are completely clean as far as any criminal records. Today something really stupid happened that I want to ask you guys about, a drunk guy traspassed into their yard and tried to hit my father, and he ended up hitting my mother and breaking her nose, my dad stepped in and defended her(without being aggressive) he just grab guys hands to prevent him to assault anybody else) and then he pushed him away(didn't want to beat him because he knew that they are coming in USA in couple of weeks), guy ran away, they called police and told them how everything went, police sent mom to ER, so she can get doctor papers as proof, and at ER they've seen that guy, he also came there because supposedly his friends told him to go to ER and try to counter police report and say that they attacked him... long story short, this is gonna go legally through police and on the court but it is gonna take at least a year for it to get to court, is this gonna have any effect on my parents already issued and still never used 10 year multiple entry visitor visa?

I can’t comment about the legal aspects /merits of the case and the effect of those on the visa, but in principle yes a visa can be revoked before its used. It’s happened before. It’s also happened before that people have been refused entry at the border when CBP is aware of criminal issues. Again this is no comment on the legal implications for your parents’ visa of what happened, just that yes in principle the visa can be revoked or entry refused if new information comes to light.

I was more interested about this case, I know it can be revoked eventually. Now their criminal background check has already been done, and this new case is still not in process , right now there is only a police report, now does immigration updates Dailey police reports ? That would be a little bit too much, but I don't know that's why I'm asking if somebody knows. Thanks.

Was only an incident report written after questioning, or were either of your parents actually arrested when the police came?

Nonody was arrested, and case is going against a guy that assaulted them, but what if he lies and says that they attacked him, there is no vitneses,  it's their word against his

It's not specified where the alleged altercation happen? The parents are not in the US, did this happen overseas? Depending on the country, some do have exit controls and if there is a legal bar, they may not be permitted to leave the country. Various nations have treaties with the US and share criminal data. So the country matters to get a fuller picture.

I think there isa misunderstanding, there is no charges towards my parents, they were the ones attacked and they called police, and this is not sure but he showed up to er also and it concerns me that he is gonna lie and say that they attacked him since there is no vitneses except my family but they won't take family as a vitnes, this happened in their home country,  they have never been to states but they just got their visa approved couple weeks ago and they are suppose to be traveling to US in a month. Now if he lies that they attacked him, can that have affect on visa

What can possibly happen with their visas depends on if he decides to formally file actual charges or not, then depends on what the actual charges would be, then depends on whether he wins the court case (if there is one) or not, then depends on what the final disposition is against your parents.  

 

Also depends on the parents home country, since laws are country-specific when it comes to not being able to leave the country under certain circumstances.  What is their home country?

 

You're assuming he will lie/file false charges....nothing sure yet.  Also the possibility that he may do nothing to discredit your parents story of events.

No charges = no issues. Stop overthinking.

Were they arrested, detained or charged with anything? If not, this will have no consequences on their visa.
