Hello All,

 

I recently sent in my AOS  paper work and received a RFE.  From this site, it was to my understanding that I could factor in child support as long as correct documentation is included.  I included my divorce decree with child support addendum and copies of months of money orders.  I was surprised that I received a RFE when I mailed off documentation that was roughly 4 pounds in weight (Any comments on that would be helpful as well).  So now I need to have a joint sponsor for AOS, but I noticed that my joint sponsor's last year tax return is slightly under the income requirements...My joint sponsor DOES make more than that currently (at the same job).  If the joint sponsor submits a current letter of employment from their employer stating their annual salary along with copies of the last 6 months pays stubs would that be enough proof to show current income?  I would hate for the only thing to be focused on is what last year's reported income was compared to what an individual actually makes now.  Any help/comments/suggestions would be appreciated.

  1. Sending ~4 lbs. in documentation may have been part of the issue, tbh. Nobody will look through that much documentation to get what they actually want to see (which should be able to be conveyed in a few/several pages in most cases). For something like child support, the documentation would be the child support decree + evidence of actually receiving the child support (maybe like 1 statement a month for a year? I'm not certain on exactly what they want to see, but it's nowhere near hundreds of pages).
  2. You need to either provide proper documentation of the income, OR use a joint sponsor. If you have a joint sponsor lined up, I would suggest going that route.
  3. What matters is current income. USCIS IOs will look at the totality of the circumstances, but generally pay stubs + an employment letter is sufficient to show current income satisfying the I-864 requirements. The most recent year's tax return is still required from them (and up to 3 years being provided is optional), but should not be a barrier for a regular wage employee.

I forgot to mention that paperwork was for AOS and EAD.  The bulk of the submission was copies of money orders (child support is not paid through an agency and at times they weren't just bulk monthly payments, but all funds are accounted for).  Believe me, I submitted Exactly what was requested, trying to submit the fewest sheets of paper.  That's why  I am a bit puzzled as to why I received a RFE....  I didn't want to re-submit again with child support attached with the chance of having another RFE, that's why I thought to just use a joint sponsor.  I was trying to avoid it, that's why I included all documentation to prove child support payments.
