Thats a very common concern many if not all people with divorce waivers seem to have. (What if they ask why you want to stay when you are divorced). All I can say is they are not suppose to ask you that. IMO if they do start asking stuff like that or giving you a hard time about that aspect of the case-- well, you have a problem. You can ask for a supervisor if it gets too heated or if you feel you are being treated unfairly. But honestly they are not suppose to go into questions like that. The only reason they might is if they suspect fraud or want to see how you answer. 

 

Technically it is your legal option to remain in the US regardless of family or relationship status. You do not need to justify why you are taking advantage of the law that allows you to stay after divorce. If it makes you feel better try to come up with a simple one line response for questions like that if needed. Something like I have established myself here in the US professionally since immigrating for the marriage and are choosing to remain here.

 Very well said! it won't be a big issue to answer that type question; obviously when you live 3-4 years of your life in a certain status and build your own business you are most likely to settle down in that way if you see your expertise or venture has no value in your originating country. That will be my answer to be honest.

I just went for my interview today. Lasted I guess an hour, the IO was nice but firm, and I forgot important informations for some reason. I didn’t get sleep the whole night organizing my evidences which I barely have and added text messages screenshots. She asked if I have questions and she said in 2-5 weeks I will received a mail either with a green card or not or other information they might ask. I can’t believe I forgot information like what other jobs my husband did coz he did so many jobs but I forgot to mention the one that’s actually in the w2. I just mentioned those under the table jobs he did which earned him a lot of money. Then I cried when I was explaining the divorce thus couldn’t even speak well in the beginning which was so embarrassing 😭😭 oh well it is what it is like you said. At this point I feel sick already mentally and emotionally just about everything I went through this 4 year marriage waiting that it might get better but still end up in a divorce bec he’s cheating already like what’s the point of it all. I still hope it will get approved so I have the options later on if I wanna stay or not.

 

Anyway I promise to give you guys an update since I didn't have a lawyer and basically just replied doing my application by reading post here.

 Thank you! Yes hopefully even though I feel like there are important informations that I just totally forgot and I talked a lot , it feels as if I was talking to a therapist or a friend which I know they said don’t talk too much. But she was nice in general that’s prolly why it felt comfortable. The only additional evidence I added was text messages and she asked she doesn’t see the dates or year and I said there are some with dates and others are continuation. Coz Idk for iMessage it doesn’t show year or every date of a message and Ofcourse I didn’t print everything , only those substantial tryin to save those papers for our environment. Lol I’m kidding. Just tryin to make us all relax. Also she didn’t ask for anything else even my birth certificate which is still currently in hongkong right now in transit. It didn’t come on time for my interview. Just a screenshot of my husbands IG post when I investigated how I found out he was cheating bec we both deleted our social media before due to jealousy. And I told her I don’t have any other additional evidence. She didn’t ask for photos either. Even my entry documents. 

 

Anyway my case is very complicated I guess more complicated than everyone has here. So don’t worry I believe y’all would have your approval soon.

F1 visa August 2014 

got married may 2015

got interviewed for GC November 2015 (approval on the spot)

 

i751 joint October 2017

not much evidences bec  aug 2016 we got into a huge physical fight but got back together dec 2016 and fight happened again.

 

whole  year of 2017 on and off (husband tryin to be sober but keeps having relapse 

 

overdose  feb 2018

year 2018 things started getting better bec he’s been tryin to get back on track

 

Things started getting better for him but he started cheating too , 4 years and 4 months we decided to divorce, we’re not in good terms and I didn’t ask him to come to the interview bec he used this over me (threats).

 

Aug 2019 came to a supposedly joint interview but I asked to amend to a divorce waiver with my final decree, IO didn’t make me sign any paper for it tho..,

 

she said 2-5 weeks waiting time for result.

Your time line and patterns match with my case a lot surprisingly. Like F1, marriage and other events. The only difference - No joint filing and divorced after 22 months of marriage. I wish you good luck and keep us posted about your result.

Did you get interviewed? And how long did it take to get the result

My case just got approved today ! For everyone still waiting!! There’s hope! I had the most complicated case and amended to a divorce waiver on the spot during my interview.

Thank you! I even lost hope already bec my case was so complicated no joint residence only a year bec after that we couldn’t afford it anymore. Almost no commingling assets.we handled finances separately bec my ex got addicted to drugs and alcohol.  I couldn’t even afford a lawyer. And filed a divorce in Nevada which I think saved my case due to my job always flying which made me capable of moving in every city/ state easily. And had a final decree with me on the day of my joint interview amending to divorce. Thank you all ! I seriously just read every case scenario here on VJ in doing my applications.

I couldn’t afford a lawyer unfortunately, but if anyone has means I suggest getting a lawyer bec I almost lost my sanity tryin to do all of this on my own lol. The stress was too much that I thought it is what it is, thank god it’s all over now.
