I have an update. On May 29, 2019 USCIS sent case to Local Office. I guess that means my case right now is in USCIS office of my residing city. So most likely I will be called for an interview or so.
At this point I am preparing myself for best and worst both part. In case USCIS denies my application (I highly doubt because my file is very clean and I provided enough evidences of bonafide relation) what can be my 1st step to appeal or refile?

thanks

My i751 waiver case was transferred to my local office for interview as well... my interview was on April 18 2019, Immigration officer told me that she would send me a letter asking for additional documents. I got that letter on April 21 2019 and sent the documents which they received on April 24th. I'm currently still waiting for a decision. My conditional residency was extended to one year. Then 18 months which would end on August 4th 2019, I made an info pass appointment and got another extension by was of a stamp in my passport for another year....

Can you please explain your interview experience and what extra documents they asked for? Thank you! Wish you the best

@jhaystorm Same question again- What documents they asked for after the interview? And what kind of conversation happened during interview? If you can tell us your experience pls and some details. Please also add what kind of supporting documents you send to USCIS at first with your file. I am trying to make this thread as one of most informative and real experience based for future guidelines to many people.

For supporting documents I sent in joint bank account, pictures from wedding and other activities, travel ticket from trip we took overseas, health insurance, car insurance, car title...... during the interview IO asked me what caused the break up with my ex wife, who filed for divorce, if I ever paid my wife to do paperwork for green card, and asked me questions from my i751 packet that was sent in... the additional documents asked of me after the interview was for marriage certificate for my new marriage, birth certificate for my kids and any other supporting documents I have...

Oh no -- Thats a weird point! I guess the ISO was ready to drop your case like denial but somehow trying to approve if you are married and have kids considering hardship. If it is the case then my case future is pretty bleak since I am not dating anyone nor married or no kid/s. Tough to guess !!!

It's hard to say at this point, it's just the wait game to see what the next step will be...

Hmm reading all this post about the waiver it gets kinda scary. My divorce was jointly filed and filed it in Nevada , I’m hoping to get my final decree before I go to my joint petition interview and I’ll just try to amend it to a divorce waiver under good faith right on the spot. Is that possible? Bec by the time I get my final decree is probably only two or three days left before my interview. And the only additional evidence I have are the text messages  between me and my husband that I was able to retrieved and photos of his new girl that he’s dating already so at this point there’s really no reconciliation anymore. Idk how they base good faith, but we entered in good faith and ended it in good faith. For 4 years that we’ve been married and struggled fixing the marriage, we came to an end and right before the interview too

since anyway he wouldn’t make changes on his schedule to even attend or help me with the interview and at this point I just have to think on how I could utilize a legal way available to me in getting my condition removed.

So my question is can I amend my joint petition to a divorce waiver when I get to my interview? Do I just tell them or do I need to print some forms for it? If even my final decree comes earlier like a week before I highly doubt they’ll receive it on time before the interview and I just thought maybe then I can get a result whether it’s approval or denial. The whole process is just excruciating on top of struggling to save my marriage before.

I'm assuming you meant your I-751 (not divorce) was jointly filed?

Yes it is.

If that's the only additional evidence you have, it is what it is :) What did you submit originally?

Financial co-mingling is the biggest thing. Shared residency, co-mingled medical/insurance, etc are pretty important too.

I believe you can by telling me in your interview.

I submitted joint bank account, we don’t have shared address it’s quite complicated bec we were not able to afford it and since I fly a lot and stay in hotels. We were on and off and fought a lot bec of money. But he got addicted and I have him on my insurance and sent them a medical record of his drug overdose; counseling sessions I had bec of a violent fight we had back 3 years ago; him as my beneficiary; health insurance; Optum cards; mileage card; and additional I could print out are text messages of our fights, and an email from him blaming me that I’m the bad cloud in his life etc that’s why his acting career went down; name calling (he’s verbally abusive) . My mistake was I should’ve just filed on divorce waiver from the beginning but since we were on and off and our fights became a regular thing it’s more like we’re just really two immature couples with bunch of petty fights so we never really thought of divorcing bec was hoping fights would stop when he starts booking acting jobs again and our money problems would go away. But other than that, I don’t really have any traditional evidences like a conventional married life. I’m 30 and he’s 31.

I actually read it the opposite way. There can be a lot of suspicion when someone marries and gets a GC and then divorces and quickly remarries (and has kids) with another person. Was the other person in on it too? Did they just marry for the card and once they got it left that spouse for their "true" love?

Also "hardship" is a separate waiver choice on the 751. Typically they will switch you from joint to divorce waiver if that's needed but I don't believe I have ever seen USCIS switch someone to hardship from joint or divorce because they don't qualify for joint or divorce. I would expect them to deny the divorce waiver forcing you to reapply under hardship if you can prove one.

You pointed something really important and honestly - very wise note. Yes -- I went through psychological disaster after my divorce and could not get along with other girl/s. I will tell ISO same that I still have feelings for her and could not get rid off that yet. Only issue that burns my thought- if they ask Why you want to stay USA where you have no family or any relationship other than only educational and professional affiliation?

I submitted moderately sufficient evidences; only last concern that comes in my thought- the derogatory letter of my ex to USCIS. She tried to pour little vengeance and mean words to withdraw her affidavit of support and also tried to get me deported for no good reason. Oh well; our relation went little awful at last stage and I talked with her rudely about her new relation even before our divorce. I hope USCIS will understand that I am a human being too and I have feelings as well. I guess I will get interview notice or a decision in less than 2 months; likely within September 30, 2019.
