Is it bigemy in US?

I am legally married to my first wife in the US. I obtained my permanent residency through my marriage to her. We are not divorced. I married another woman two years ago in my home country.  I applied for USC. 

Here are my questions:

1. Is it still bigemy in the US since my US marriage is the legal one and the second is not recognized 

2. Will USCIS find out about my second marriage

3. If my wife here in the US reported my second marriage but has no evidence how seriously will USCIS take it?

that is fraud to gain immigration benefits under false statements. if and when USCIS knows about it, they could/will terminate your LPR status and/or citizenship also depending on your status. Once your citizenship is terminated, you will not have grounds to be here at all

8/22/2018                  We are still reviewing your case and there are no updates at this time (same email again)

9/5/2018                     We are still reviewing your case and there are no updates at this time (this is getting boring!!!)

10/3/2018                  We are still reviewing your case and there are no updates at this time (this is insanity, 4th time while some got GC)

10/17/2018                After 136 days of wait in HELL, finally EAD in production

10/21/2018                Card was mailed to me, and yes it said so on a Sunday night, while Vj-ing

10/22/2018                Card was picked up by the USPS

10/24/2018                EAD in hand. F%^&& finally

12/28/2018                Interview has been scheduled. Waiting for notification with date by snail mail

  • Yes it is bigamy. Of course it is.
  • Yes USCIS will find out. Why do you think it takes so long to do background checks?
  • Your wife don’t have to Report your marriage. USCIS already knows about it. That is how you got your green card. They have marriage dates and all. This is a HUGE problem you are attempting. 

Best you rescind you application for the second wife. It is NOT gonna happen. You have to get divorced first, then remarry the other woman in your home country.

Your marriage to the second wife isn’t legal because you were not divorced from your first wife. In order to marry your second “wife”, you must legally divorce your first wife then marry again. Again for like the millionth time, if you’re married somewhere you’re married everywhere. There’s no “I didn’t marry in the US so it’s not legal” thing. A marriage is legal EVERYWHERE. And yes being married to more than one person makes you a bigamist.

Wow!   You have dug yourself a deep hole here.  It might be time to consult a very good immigration attorney if you want to salvage your LPR status.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I also think it's cruel to the first wife. He should do the decent thing and divorce her so she is free of him and can be with someone who loves her. 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

You actually need to divorce wife #1 and annul the second marriage and marry her again if you want to petition for her.  Be prepared for a long interview.

YES, they will find out,

YES, your naturalization petition will most likely be denied since you LIED and you can not petition your other “wife” which is not your wife because you are still married to your actual US wife...

 

So I don’t know what you had in mind but this......”not so smart” idea (is very bad)

Why would somebody in their right mind do this!

 

Get yourself an attorney if u wanna stay a LPR

just my opinion!

 

Oh and also...does your real(first) wife know about all this?
