My fiance is coming to America on a K1 visa in two weeks. We are planning a short turn around for the wedding so he doesn't have to be out of work for long. How does the process for the AOS filing work? How long will it take to get a temporary work permit? Is there a website that explains all of this? Also could he get a drivers license right away or does he have to wait till he gets the work permit? Any advice will be much appreciated! Thanks!

The first thing I did when my fiance arrived was add him to my bank account and get his SSN.

Once you get married you can apply for AOS, AP and the EAD....currently, advanced parole and the employment authorization are taking about 5 months. He will not be working anytime soon...

The state you live in dictates when he can get his license to drive  (my state says after the EAD).

Thank you for the quick response! When we file for the AOS the EAD gets filed as well right? That's the I-145 form?

How do we apply for his SSN?

The I-485 (AOS), I-131 (AP), and I-765 (EAD) - plus all supporting documents - would be filed together. You only pay for the I-485.

You can complete an SS-5 and present it at your local SSA. They will likely have blank copies there as well. You must file within the first 76 days of entry on the K-1, or else you will need to wait until the EAD arrives for the next opportunity to get an SSN.

Okay great. So, we will file those ASAP since they seem to be taking longer than expected. How long do does this whole process take usually? 2 years?

You apply for all at the same time (AOS, EAD and AP) When you file the paperwork together the total amount is  $1225.

To get the green card....it depends on where you live....where I live it takes 7 to 18 months  (I have one of the faster processing centers) But your AP and EAD should come within 5 to 7 months. @geowrian can correct me if I am wrong  (I'm still new to the AOS process)

Yeah, I did notice that it depended on where you live. Hopefully Arizona isn't too slow..... Thank you everyone for your help!

Yup, file then as soon as you have the documents after getting married.

AOS timelines vary by local USCIS office. Some could be as short as 4 months while others could take closer to 2 years. Most tend to be in the year or longer period right now.

That's about right. A few very lucky people get through AOS in as little as 4 months, but they're certainly not the norm.

AP & EAD timelines are also varying heavily. My wife got hers in just over 3 months this year, but most people tend to be in the 4-5 month range right now. Some are taking 6 or longer months, but I'm personally skeptical of that being a norm at this time.

Thank you all for the help! Now we have a better understanding on how long it'll take for him to start working.
