I-864 Annual Household Income

Hi,

 

I am a USC and petitioning I-130 for my foreign husband. Our I-130 package was delivered on April 9 and our PD is on the same date. So we have started our long wait for the NOA2. In the meantime, we want to start the preparation for the NVC process. Right now I am trying to fill in the I-864 and found questions about the income part. Tried to search around on VJ but in vain so hope you can help me out.

 

I currently live with my husband and our baby  in overseas and have a contract based job. I will work until end of July so I expect I will be unemployed during the NVC stage. So on my I-864 I will fill in my current individual annual income as $0 (Part 6 Item 7). I understand that my husband’s current income will not be counted as it will discontinue once we moved. In this case, I won’t need to list my husband in Item 8, right? Should I leave this field blank or type “None” in Item 8?

 

Our current annual household income should be $0 as well (Part 6 Item 20). However, I could not type anything in Item 20. I believe this field is calculated automatically based on Items 7, 10, 13, 16 and 19. Since I won’t put any numbers in these fields except Item 7 which is $0, how can I answer Item 20? Should I write $0 after I print the form?

Ive seen this mentioned a few times and it is still confusing to me.  If I currently make "X" amount, up until Feb 2019, when my current contract ends, why wouldn't that be used as current income?  In my personal cover letter I have stated clearly that my income will stop at that point, but if I am going to interview before Feb 2019, why wouldn't I claim my current monthly salary as current income. I've given a copy of my contract, which states what my salary will be up until Feb 2019, and a certificate of payment from my employer showing my previous three years salaries.  In your opinion should I also claim current individual income is "0".  I have used "Zero" for the total income regarding question part 6, question 24a-c, based on line 22 of my 1040 tax return, but unsure about current income.  TIA.

Current income is current income, not year to date income.  If you don't have paycheck coming in "currently" then your income is zero.  However, note the words "that you are using....".   Even if you were still working when you submit the I-864, your income would still be stated as zero because you can't "use" it to qualify.  You can't because it won't continue from the same source back in the USA.  Become an A-Student of those I-864 instructions.  Really.  Do it.

I'll yield to your expertise here, but that is an extremely convluted distinction being made that I still don't fully understand. I think it's time for the instructions to get an update. Seems like they could be written much more consisely, bút i súpect it may be intentional.  Thanks again.

Current income is current income.  Current year income is current year income.  Year to date income is year to date income.  You are asked for current income and in the instructions you are told in two separate places, 1. that only income continuing from the same source can be "considered" and then asked 2. to enter the "income you are (present tense) "using" to qualify.  Since you cannot use income that won't continue from the same source, you "are using" zero income.

 

Yes, that's convoluted.  I don't think they intend to confuse, but they certainly do not intend to write the instructions so that a layman first timer finds them easy to follow, or for them to be "intuitive".  Go figure.
