Would it be possible for him to move to you?

Yes it's possible but that wud be a very big sacrifice on his part...we were actually thinking of  that before this noir showed up.

You see we Africans take care of even our extended family members, if he's moving in with me, who is going to take care of these people, he will need a job, n trust me finding a job here is a very big deal. It wud be a bit easier for me to rather move. He can only not more than a years with us.  U see y these lies from this CO is a bigger blow.

NOIR is intent to revoke not like NOID which is intent to deny

you can respond to a NOID

NOIR requires an appeal

appeal there is a fee and about a year to hear decision / in this case the NOIR will probably be upheld as the responses are weak or missing

i would reapply and send a letter with new application to address these issues

at a new interview you will need to be more competent and have more confidence with your responses

get to know the person

get to know the life in the US

get to know each other

that means everything / if you knew things,  your responses did not show it

real relationship means showing love,  understanding and a lot of patience

show you are making future plans (studying or working  in the US)

Thank you very much, I do appreciate ur response

She got a NOIR (it's in the title), not a NOID.

Either way, the point is that a NOID applies to the initial petition whereas a NOIR applies to a previously-approved petition.

People may rush to use harsh words at you, I don't blame them because if any of them ever experience this your situation they would understand. The CO's are professional and we all know they are trained to do what they do but, we all know they are not there to give everyone visa despite the legitimacy of your relationship. they have a quota of how many they can issue every year and they will deny anyone and make up stories. I know how you feel because I have been through that before. The CO's are fond of lying about everyone they denied. We were denied for no reason and later in the memorandum they sent to the USCIS they stated a lot of lies in it and we overcome it so easily because they lied. We even told the USCIS to ask the embassy to furnish them the audio excepts of my interview to confirm all that they said in the NOIR. Just submit your communications, letters from your family and the man family attesting to the legitimacy of your relationship, write a rebuttal letter yourself and address all the points one after the other and state all the answers you gave at the embassy to the USCIS, add every iota of receipt concerning you both, whether is western union, road trip receipts, his boarding passes, cards and gifts you both send each other, if he have you on as beneficiary of any of his benefits including insurance and 401K plan, show them communication that dates back as early as the times you guys met. Give them many pictures. The USCIS is by far better than the embassies in dealing with cases base on facts and materials rather the perceptions and personal opinions. This is not the end of the road, if you allow them to win then is your choice, but I tell you what, if you peruse it by submitting more proofs and documents, you will receive reaffirmation letter.

well yes CO can be harsh and judgemental. 1st time when we went for our interview, CO shut me down and we were given NOIR. We fought back and we got the second interview after 14 months (approx) (don't remember exact time frame) but in our second interview, we were approved.

I don't blame CO. They are just doing their job and if they see anything suspicious or feel that way they reject it. I say this is a true test.  read my profile and story and you will understand why I am staying true test.  Because a fake couple won't put so much mind-numbing effort and spent tons of money and wait and wait and wait for an unknown timeframe to be together with loved ones.

reply your NOIR with proof and a detailed letter explaining it. We hired lawyer the moment we were rejected. Even thou we collected all the proof, the lawyer wrote a formal letter on our behalf (worth paying every penny for lawyer for that single letter)

Im the the beneficiary, trust,,,I was very shock and a angry to see these as the reason for our denial.... I answered everyone one of those questions...had my interview 2 years after Marriage n plus 2 year of knowing n constantly being in touch. We communicate almost everyday n I sent our call logs to the interview. I just have to accept n find a solution to the problem at hand that's y I'm here soliciting for ideas...tnx

Have you ever asked your self if the beneficiary is willing to joining you over there. Failing such a basic question is truly unheard of ... That could be a deliberate attitude to fail the interview in other to stay back.

It is not unheard of people failing an interview if the person has been getting money regularly from the US person.  The worse case I am aware of if the beneficiary actually was starting a home for their African partner on the monies sent .   As to the people that say any applicant should be able to answer all the questions,  that isn't always true.  In fact due to the way the officer asked my husband the exact details of the job question  I was able to file charges  against her.   Then again to this day he still couldn't answer the exact details of my job.

This will not be over quickly. You will not enjoy this.

A little tangential here, but I usually tell people the beneficiary should know all the things about the petitioning spouse that spouses would know about each other if they lived together.

So, for example in Nigeriaorbust's situation, the spouse would NOT know the details of her job.  As such, hindsight and learning from the experience of others tells me that it may well have helped to be prepared for such a question with a frank answer, like "She has a security clearance kind of job where she is not allowed to describe it in detail."

In preparation for my then wife's interview back in the day, a common question would be, "Why do you love him?".  In our preparation sessions, I asked her to tell me in her language, then I came up with a way to say pretty much that same thing in English and taught her how to answer that question in English and rehearsed it many times.  "Because he is good hearted, handsome and he makes me laugh." was her answer but the question was never asked and not a word of English was spoken in her interview.  You prepare the best you can and then you deal with what happens.  We were luckier than most when it came to the interview.

Facts are cheap...knowing how to use them is precious...
Understanding the big picture is priceless. Anonymous

It was to the extent the CO pushed that led to me filing,  He knew where I worked, how many years I worked , the hours I worked, what my degrees were in  and basically what the company made.  Even knowing that she insisted that if I wanted him to have a visa he needed to give her exact details of what I was doing at work.   Nigeria can be an unreasonable place at times.  The second interview the CO had the nerve to ask if his father died because he was in love with a white woman .   I have a very low opinion of the CO's there

This will not be over quickly. You will not enjoy this.

By the grace of God, the case has been reaffirmed.

We didn't even involved a lawyer, my husband responded to the noir by himself. God has been faithful, we're are waiting to be scheduled for an interview.

We can only say God made a way.

By the grace of God, my case have been reaffirmed...I'm surprise how people can be judgemental sometimes,  only God knows how hard this whole thing is,,good thing is, God got us...we didn't involved a lawyer, we only tried with the little evidence we had to show that all those claims on noir wasnt the real picture of what happened at the interview, we had other plans, his ticket is already bought to come back home to me, but God showed up...although he's still coming, I strongly believe that he's not coming to start all over like we planned, I believe he will go back to his work and I will join him.

I can't say thank you enof to God for this hope.
