Can 10 years old child file i-765 while i-485 pending?

Hi every one, 

My son & I filed AOS c9 in Dec, 2017, I did concurrent filling i-130, i-130a, i-485, i-765, i-131, but my son did just i-130 and i-485.

PD: 12/15/2017

Bios done: 01/26/2018

EAD update "New card is being produced": 04/26/2018

AP: no update yet

 

As we all know, processing time seem to take longer than ever, so now I'm filling i-131 for my son, my question is:

@ can my 10 years old son file i-765 (to apply SSN)?

@ can i-765 and i-131 file together? What documents should I include (as I searched on USCIS website, all they need is only an application form and i-485 NOA)

Appreciate if anyone has experience

Yes, you can and should file an I-131 and/or an I-765 for your son. There is no fee provided you have paid a fee for his I-485. Enclose a copy of the I-485 NoA as proof of this, and the fees for his EAD/AP will be waived.

 

As you say, this is the only way a derivative K-2 can obtain a SSN until they have their green card.

Day 385 (1/23/19) Denied

Day 400 (2/7/19) Denial revoked; N-400 approved; oath ceremony set for 2/14/19

Day 407 (2/14/19) Oath ceremony in Dallas, TX
