my fiance arrived in the US march 2nd..i know we have 90 days to marry..but what is the time frame to apply for her AOS?...thanks...mike

july 2004 met online first time through a good friend

april 2006 reintroduced

may 2006 things start heating up

june 2006 fly to manila to meet her and propose

july filed 129f

aug 11 received csc

aug 17 noa1

oct 24 approved

oct 30 noa2 rec

nov13 recd nvc

nov21 lft nvc

nov24 recvd manila

feb 15 med exam

feb 22 interview

feb 22 approved

You must get married in 90 days. AOS no timeframe as long as you are married but I would think you would want to apply right away for travel, employment and greencard.

Congrats on your upcoming wedding and having your fiance here with you.

2/24/06: 129 mailed

3/01/06: NOA1

5/02/06: NOA2

5/18/06: CDJ Receives case

7/19/06: CDJ mails packet

8/02/06: Interview - Visa not recevied - put on AR "false hit" fingersprint check had to be done.

11/15/06: Called DHS to see if they had any info on my case - They advised security cleared in Oct. - now waiting for appt letter from CDJ for Visa Pickup. :)

11/27/06: recvd letter from CDJ - Appointment set for Jan 11, 2007

1/11/07: Visa received!!!!!

AOS:

3/26/07: AOS mailed

4/3/07: NOA1

4/23/07: Biometrics Appt

5/2/07: AOS transferred to CSC

5/21/07: Email from CSC stating AOS pending

6/12/07: EAD Card ordered (received email)

6/20/07: EAD Card received in mail

8/23/07: Card Production Ordered

8/30/07: Greencard received in mail

Lifting of Conditions:

5/26/09: I-751 mailed

6/1/09: NOA1

6/3/09: Check Cashed

7/7/09: Biometrics Appt

10/30/09: Approval Date

11/5/09: Received Notice in the mail

11/21/09: Greencard received in mail!

Naturalization:

8/12/10: N-400 Mailed

8/20/10: NOA1 (check cashed 8/24)

9/8/10: Early Biometrics. In and Out in 5 min!

9/22/10: Scheduled Biometrics Appt

11/4/10: Interview Appt - Passed!!!

01/27/11: Oath!!! Yippee!!

Neonmikey,

Technically there's no time frame - but once the K1 expires you (foreign fiancé, now spouse) is considered 'out of status' until AOS is filed for. It's (of course) best to file as soon as possible. Was there some reason you are concerned about time frames?

Hope your upcoming nuptials go well.... :thumbs:

Ditto to the info above, have a happy wedding and I would work on that Aos packet as soon as you are done with the honeymoon.

06-28-07 Green card arrived in mail

April 2009 Filed for removal of conditions.
May 09 2007 Biometrics
Aug 31st Congratulations letter, no interview needed
Sept 21st 2009. New green card with conditions removed arrived.

N400 Status
07/26/10 N400 mailed via UPS. Three year rule
08/03/10. Check cashed.
08/06/10 NOA letter received, but "Request for evidence" showing on the status website.
08/08/10 NOA #2. Biometrics appointment letter. Scheduled for 08/31/10
08/09/10 Biometrics completed. Walk in.
11/01/10 Touched. Transferred to local (Tampa) office
12/06/10 Interview . Passed
01/11/11 Oath ceremony

I think it's best to apply as soon as you can - that way your fiance will not be out of status.

It's a bit of a pain because w/out the green card the non-USC is not a resident.

11/2004 - Met in Brazil

09/2006 - Apply for K1

03/2007 - K1 approved

04/2007 - Apply for AOS & EAD

07/2007 - EAD approved

01/2008 - Conditional Residency approved

11/2009 - Apply to remove conditions

02/2010 - Permanent Residency approved

11/2010 - Apply for Citizenship

03/2011 - Citizenship approved

07/2011 - Moved back to Brazil
