Hello Everyone!

 

I am new to this Forum. I have applied for my Fiancé back in September 1st, 2018. I initially thought she will get approved within 6 months From September. As I was progressing the time was getting worst and worst. I started looking around for more detail information about K-1 Visa. I am a US Citizen by the way.

Long story short. I have submitted my RFF based on what USCIS has asked me. There are 4 things that they asked me for:

1. Proof of Citizenship

2. A copy of a Passport size picture with the specification. ( Details are available on USCIS website as well.)

3. A letter from my Fiancé to stating that she will marry me within 90 days of her arrival to USA. (FYI: there is a app called FIANCE VISA) download that, it has step by step process)

4. A supporting documents to proof that we are eligible for waiver " 2 year of meeting requirement prior to file the I-129F"

 

I submitted all these documents on 04/19/2018, Still haven't heard back about anything, not even if they have received it or not. It is in California Service Center(CSC).

Does anyone have any Idea how long it may take an average. The Customer Service of USCIS has told me, it will take about 60 days. They seem to be very linen about timing, I also noticed they are still working on September 29,2017 application. Keeping that in mind, I am curious to know what would be the ideal time and what are the chances that I may get APPROVED?

What would happen if they don't approve for some reason?

 

Please advise if you have any experience related to this.

Do you live in the future? :-) Just kidding.

You keep writing 2018 and now I am little confused about where you say the are working on cases from September 29, 2017. Do you really mean 2017 or do you mean 2016?

Are you applying for the 2 yr meeting requirement waiver? It is my understanding that is rarely approved. Was your RFE for more evidence of relationship? Search this website for cases asking for the waiver for the 2 he meeting requirement. It almost never gets approved and they always come back saying it wasn’t approved and end up having to go meet each other somewhere then start all over again.

Yes, I had submitted mine with the waiver when I applied but then I was still missing my proof of citizenship and the passport size picture. Then Also had to submit the Intent to Marry letter from my fiancé.

And asked me to get a letter from a local Official saying my statement is accurate what I have explained. Which I did submitted additional Official Documents from a  Local GOVT. Official in Pakistan.

I was not able to meet my fiancé but we do chat through social media.

I am hoping the document that I submitted as per their instruction, it should get approved but can't say it for sure. As you mentioned they are pretty strict when comes to this 2 Year requirements.

On what basis have you been unable to meet your fiance? My knowledge of this - it's for extreme medical/religious reasons only. Even people on dialysis or confined to wheelchairs have not been given the waiver for medical reasons.....

 

My guess is this hurdle will be very difficult for you to overcome.

I have reason with the religious and local laws. I have gotten letter from a Religious Scholar and sealed by them. Also gotten letter from Official govt. stating that the reason is legible and accurate.

I have said I will do the Religious ceremony upon her VISA approval by going there. Also stated that I want to minimize the cost as you know eastern culture spent too much money on their wedding ceremony's; I pray that I overcome that situation.

By "doing a religious ceremony" - do you mean a nikkah nama? If her visa is approved on a K1, she has to be free to marry in the US - if you are doing a "religious ceremony" or a nikkah nama it could be seen as you will be getting married there after she gets her visa - which would mean that she would no longer be eligible for the visa.

Yes I will do that once she gets here. Once we are both in USA.

Earlier you said, "I have said I will do the Religious ceremony upon her VISA approval by going there. " which seems to imply that after her visa is approved you are going to go to Pakistan to do it - not when she comes to the US

Yes, that what had planned intially but if that seems to be a problem I will do the Nikkah nama over here in USA.

Be prepared for a K1 refusal is all I can say... it's creating a big problem

It certainly created a problem in that they will most likely deny her the K1 visa since you have shown intent (in writing) that you plan on marrying outside of the US now.
