I am a K1 applicant. Already in USA and just got married. How long before can I start going to school or uni ? I wanted to study something before EAD arrived because that’s going to take 3 months or longer. I’m really getting bored having nothing to do. I want to apply for school (nutrition) and based in Louisville. I’m talking about myself. Not my kids (don’t have any)

As long as you are within the 90 days of entry OR have applied for AOS, you are in the country legally and permitted to attend college/university. That said, many times they will treat you as an international student until you meet certain residency requirements. This is something to discuss the the college/university...some people have had success getting them to treat you as a local student, others had to stick with international student rates for a year or so.

I'm in this situation now with my husband. He is on the K1 and bored out of his mind. He wants to start school. We applied for AOS last week and the local community college is allowing him to attend with in-state tuition starting next month for the summer session. Definitely talk to them! He is kind of being treated as an international student with in-state tuition rates. They are making him take the ESL test Monday. If he passes it, he can start school the week after. If he does not, then he will have to do English remedial classes to get him up to a place where he would be successful in classes. Good luck!

  • 3 weeks later...

UPDATE: Husband passed the ESL exam and is starting community college in 3 weeks and is getting in-state tuition! Now he can do SOMETHING while he waits for his EAD card. We have our biometrics for AOS on Thursday.
