Abandoning AOS after entering on K1?

Hello again!

I have had a K1 visa before, entered the US, got married, got my ead and my ap and filed for aos.....however, i left the country 6 months later because i did not get along with my then husband at all, and never notified any service center or anything. This is BAD, right? I am engaged to another american and in the process of applying for a k1 or k3....is this really, REALLY bad?

If no action is taken on the petition, they will simply consider it abandoned. But they will know if you are petitioned for again. It could reflect negatively on you.

You best approach is to disclose everything. I am assuming you divorced your first husband? If you haven't you cant start another petition until you do. I don't think a wavier is needed, but i don't know for sure. Your best bet is to talk to an attorney and see if they know of any obstacles.

yes, I've divorced on good terms and I am still in touch with my ex-husband. I realize it will reflect bad on me that I have already filed a K1....but they gotta understand....no one in their right mind would want to go through this ####### again? I definitely did not plan on falling for another american, lol.

Timeline

It should not create serious problems for you but when you do apply don't be surprised if you find yourself in Administrative Review for a while as they check into what happend before. There are no limits to the number of K-1's a benificary can do.

12/14/2006 Applied for K-1 with request for Waver for Multiple filings within 2 years.
Waiting - Waiting - Waiting
3/6 Called NVC file sent to Washington for "Administrative Review" Told to call back every few weeks. 7/6 Called NVC, A/R is finished, case on way to Moscow. YAHOO!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
7/13 On Friday the 13th we see updated Moscow website with our interview on 9/11 (Hope we are not supersticious) 9/11 Visa Approved. Yahoo.
10/12 Tickets for her to America. I am flying to JFK to meet her there. 12/15/07 We are married. One year and a day after filling original K-1
12/27 Filed for AOS, EAD & AP 1/3 Received all three NOA-1's 1/22 Biometrics 2/27 EAD & AP received 4/12 Interview
5/19/08 RFE for physical that she should not have needed. 5/28 New physical ($ 250.00 wasted) 6/23 Green Card received
4/22/10 Filed for Removal of Contitions. 6/25 10 Year Green Card received Nov, 2014 Citizenship ceremony. Our journey is complete.
