I am so confused now. I “think” I can file I-130s for Rose and the kids but AJ turns 18 on July 18 so Rose and I need to get married before that so I can establish the step parent relationship with AJ.

So three I-130s and fees each and we get married before AJ turns 18 and we “should” be OK.

Is this correct?

Stepparent/stepchild relationship needs to be created before the 18th birthday.  Separate I-130's for each intending immigrant

YMMV

Thank you. So right now my main concern is getting married before July 18. Once we do that the rest may fall in place.

Yes that is correct.

Here is the link to the I-130 instructions

https://www.uscis.gov/system/files_force/files/form/i-130instr.pdf

Under  WHO MAY NOT FILE

You may NOT file Form I-130 for a person in the following categories:

3. A stepparent or stepchild, if the marriage that created the relationship took place after the child turned 18 years of age;

t Take your time, slow down and read the I-130 instructions, and form completely, then read it again so you become comfortable with it all.  ;)    NO   this time!

It is confusing. I am going to make sure we are married prior to his birthday. I am going to try and following to the letter but it seems some places make it so I can’t take him and others look like I can. I have to find out if they all get the green card or just Rose. I will read everything a few times

Since their is no derivative benefit on the IR visa.  That is why you submit 3 I-130's.  The result will be  ALL the same.  Green cards for them all

YMMV

At this point I don't care about the money.  I do care that we get everything in place and married before AJ turns 18!  Thank you.

Relax ..  you are stressing.   Read the I-130 info  .. slowly.    Do take note that the I-130 is used for all immigrant visas, some info is for green card holders some for USC, which is why you read slowly.  ;)

Completing the marriage in a timely manner should be #1 on your list.

John sorry to hear this.

We had interview today, also 221G handed to her, they kept all the documents including her birth cert, nbi, police clearance, passport photos and attached them to the ds160 and gave her passport back along with the 221g, she asked what about the visa or is my visa approved? they said its "now under administrative process" and then she asked if not denied then how to send the passport to get the visa on it, they said somebody will contact in a couple of days about your k`1 fiancé visa

so now I don't know what to think?

I may either refile or cr1 if its denied, they didn't say approved or denied.

they opened the medical folder, and gave back to her the folder with the cd and it still sealed.

Overall the CR1 is more paperwork upfront but you'll have nothing but collecting evidence for ROC after arrival.  Your fiance will be able to work right away which, imo, keeps away some homesickness.

I may write a comprehensive comparison since I am doing both.  The differences are still confusing to me but I am slowly learning.

You missed out on the whole AOS which is majority of the paperwork and headache for a K1 though. ;)
